Yes, you are right they should have consider your application from the link you have given. Did you explain situation in the cover letter? It might be the caseworker didn't know that you are varying your application.

Well i have look at both application form and guidance notes but i didn't see that statement. Can you copy and paste the statement here and the link.

You always got option to make another SET LR application paying correct fees.

You are eligible to apply for ILR 28 days before the your current visa expire. You don't need another extension.

It seems those guys they were kind of looking for excuses to denied your visa. Reasons they have givens there, doesn't make sense to me. I think you have done as much as anyone could have done to prove that you are genuine student and they still refuse. Think through your options, may be you can try...

You can use PEO because your appeal was successful.The worst that can happen is they might want to make further inquiries and therefore you might not get decision on the same day.
