Re: Confirmed return ticket while boarding flight ,outside E

It does not have to be the same airline or even the same ticket. You can book a separate ticket back. It's better to book a fully refundable ticket and then cancel it once your parents have boarded. Alternately, use a service like flyonward which charges around $10 and gives you a 24 hour validity t...

Re: sound advise wanted

Regarding which country is the quickest for an article 10 RC. It's not really clear. Spain takes upto 6 months to give the RC but in all cases you can stay in the country while it's processing. Germany used to be very quick atleast in Berlin (1 month max) but a prior appointment is required and I do...

Re: sound advise wanted

There will be no issue in applying for an RC in an EU member states even if you enter using a visa from another schengen country. It's a fairly simple process. However, to get the schengen visa in the first place might prove challenging at first. I don't know which consulate respects free movement r...

Re: Long wait for appointment for Family Reunification Visa

As far as I understand you are not eligible for a family reunification visa. That's either for Spanish nationals living in Spain or 3rd country nationals who are living in Spain and want to bring over their family members. You would need to apply for an article 10 residence card. This is because you...

Re: Schengen Visa Overstay - Poland

You overstayed your visa and are now saying that the Polish border guards just want to make money? If they noticed that your visa was invalid, why would they let you in as an 'illegal'. What guarantee do they have that you would leave in a few days? Would they do all of that to just make 100 EUR ? W...

How did you count 6 days as your stay?

What time do you arrive into the Schengen region and on what date?

What time do you depart from the Schengen region and on what date?

Re: New EU deal: Free-movement rights gone?

Bingo! Thanks for posting that whitepaper Starnes. That makes things a whole LOT more clearer. I had posted earlier in this thread that the idea is to prevent illegals from easily regularising themselves in the EU through marriage (because EU law says you cannot expel spouses under almost any circu...

Re: New EU deal: Free-movement rights gone?

I don't think OR is AND. There have been drafts of this decision proposed through Donald Tusk's letters prior to the final draft that we have seen. However the line of reasoning you are going for (even if it is OR) does make a little more sense. Imagine a person who has tried to enter the EU via a r...

Re: New EU deal: Free-movement rights gone?

I have a question for this already interesting discussion. So assuming Brexit doesn't happen. Now, for non-EU spouses who never lived in the EU free movement is "dead" and technically national immigration rules apply. Wasn't Directive 2004/38/EC enacted into every EU country's national legislation a...

Is derived free movement of non-EU spouses effectively over?

It looks like the EU has agreed to restrict the free movement of non-EU spouses of EU nationals if Britain votes to stay in. The language in the EU council declaration is pretty worrying and has very broad reach: The Commission intends to adopt a proposal to complement Directive 2004/38 on free move...

No point in thinking too much about it though - I will plod on! I understand the spirit of what you're saying there. But as a non-EU spouse who is planning to move to an EU country (not the UK..) with my EU spouse at the end of this year.. this might actually affect my plans tremendously. I think m...

Re: Schengen Visas for non-EU Spouse - Queries

Those proposals look terrible! Especially for Non-EU spouses/children. So just to understand correctly, for non-EU spouses who do not live in the EU, the proposal would effectively remove the 90 day no-strings-attached free movement and instead the EU spouse would have to move to the member state (s...

Re: Married South African couple, different Schengen visas?

You could ask them but most likely they will say that your husband should apply again for your next visit. You could make the argument that you'd have to pay again but your mileage may vary.

It could be that they didn't want to give him a multi entry or it could just be a clerical error.

Re: Non-EU Spouse (Argentine) moving to Spain to join UK hus

You can easily go for method 1 and your spouse can register for residence after arrival. However, it takes up to 6 months for Spain to issue a residence card. During this time you can travel and also stay in Spain (and it will not count as an overstay) so it should be fine.

Re: Sweden denied visa to non-EU family members.

I am already thinking of getting them to apply to another Schengen visa as soon as possible so we can go on vacation.
It appears from the above statement that they are indeed going to be together in Sweden so it sounds like the directive should apply.

Re: Schengen for holiday.. confused..

Yeah sometimes in the EU they forget to stamp because of the differing regulations for different situations. You should ask for it though to be on the safe side. The 30 days are counted INSIDE the Schengen region. Stamps are just proof of entrance and departure, if you need to prove that. Did he get...

Re: Schengen Visas for non-EU Spouse - Queries

Yes, you will have the right. But prepare to answer some pointed questions by border guards when you leave if you do not decide to process residence during the same visit. For the most part, as long as you fill 90 days as the duration of your visit on the Schengen visa form (which you will have to f...

Re: Schengen Visas for non-EU Spouse - Queries

You're overthinking this. Most Schengen visa cases for non-EU spouses of EU nationals are successful. You may or may not get 90 days, they may or may not know the rules up front, you may or may not need to inform them of the rules in force, but most of the times, there shouldn't be a major issue. So...

Re: When Schengen embassy ignores rules...

That embassy page looks ridiculous and totally out of line. You should report them.

However as I understand it, your parents can't use Directive 2004/38/EC for travel if they are not traveling with you or to join you. Isn't that right?

Re: Moving to Germany with Non-EU Spouse

Oh ok, that makes sense. I would honestly +1 your earlier suggestion about getting married in South Korea though. It would make things a lot less complicated. I wasn't aware that getting married in the UK on a visa waiver broke some rules.
