I'm not even sure what your point is? Section 4L and ARD are definitely new avenues for people to register and a whole lot easier, and I would assume cheaper, than judicial review. ARD is a simple application that costs, in my case at least, 80 pounds total. 1. That 4L would not apply to the OP. 2....

I am not saying that there are not circumstances where section 4L would apply, but that will require the applicant showing legislative unfairness, this is not something new, judicial review has always been available for nationality cases, equity prevails.

Section 4L BNA 1981 - this is not a catch all for anyone to apply, there has to be legislative unfairness, this does not mean that citizenship by “double descent” is now recognised. You can travel outside the UK if you’ve applied for British citizenship. Ok so two things: 1. Yes you are eligible to claim UC, as you’re settled. However your spouse, if subject to immigration control eg no recourse to public funds restriction, then they would fail the habitual residence test and your claim would be paid as a single person, but would consider any income...

The GP should not refuse a fit note if she’s had back surgery. She needs to be assessed for work capability and he needs to claim carer element if she gets daily living PIP. It must be a joint claim if both eligible.

If they have indefinite leave to remain, the Home Office will consider they meet the legal residency test and also disregard the last 10 years residency issues insofar as there were not further character issues after that period.

No, as you’re not renting there shouldn’t be an issue about claiming UC. Your spouse would need to claim but would fail the HRT and therefore would have her side of the claim closed leaving you with a single claim but any income/capital she has would need to be declared each month. Potentially. If you were not present in the household and your partner would otherwise get a single person discount on council tax liability then your presence increases liability by 25% and therefore increases council tax support which in turn increases the amount of public funds paid.

Yes although your claim gets closed as you fail the HRT any income/capital you have still needs to be reported to UC each month. You should write to DWP debt management and ask them to remove your name from the debt letters.
