I Junior, congratulations on the success of your mums case, and sorry to hear about your brother's predicament. As stated earlier, they will try and stop him from having his residency, which he is supposed to get if he meets the conditions. The directive is an instruction, which gives memberstate di...

Unfortunately the child cannot be Irish. If he or she was born 3 years after your lawful stay in Ireland, then the child would have qualified for citizenship. You would have to wait until you have citizenship, which will hopeful be before the child becomes an adult, and apply for his or her one too.

Hi Ben, The reason why i referred to them as Irish Immigration Authorities rather than GNIB or INIS(DOJ), is for the benefit of readers of the thread who might not be familiar with those terms. The Airlines lady correctly stated that the GNIB have started doing passport checks on depature, and it wa...

However, i will beg to defer with you on the need to hire a solicitor. They are not worth the money for sure.

Proof of address is not required for a Residence Card. You can be living in a different parking spot each night, and that is fine. The Eu citizen does need a job or to be self-sufficient. But a fixed address is NOT required. I know this, but the Justice Department thinks otherwise. In the weeks lea...

No it doesn't matter one bit. Your wife entered in compliance with EU and national rules. Even if she entered clandestine manner, her residency should not be affected, as stipulated by Metock. The embassy should have been able to confirm without calling London, that any civil marriages recognised by...

If your partner has to travel, you might want to consider having her passport certified by a Solicitor for a small fee and sending it to the Home office, with proof of his travel arrangements. You could also write a small explanatory note stating why his passport cannot be sent. That would probably ...

47 Since it considered that an interpretation of Directive 2004/38 was necessary for it to give judgment in the main proceedings, the High Court decided to stay the proceedings and refer the following questions to the Court for a preliminary ruling: ‘(1) Does Directive 2004/38/EC permit a Member ...

The department of justice would require a Bank Statement in either of both of your names as proof of address. You need to apply for PRTB as that would be required for your application. You do not need to supply it immediately, but would need to send them a proof, showing you have at least applied fo...

The Community Welfare Officer would most likely visit your house to check your living conditions, your income and expenditure. You can tell him you are separated and that might be fine. As a married couple, he would want to assess your wife's income too. Under EU law, you cannot loose your right of ...

That's quite a nice photo of yourself, next to the border stone. You seems quite relaxed and at ease, you also appear much younger than i would have imagined. So that border stone marks the official border between Liechtenstein and Switzerland. No border guard, no equivalent of Garda or UK Border ag...

You are perfectly correct, and thanks for the correction, there is a Swiss-EU bileteral agreement, which was signed between Switzerland and EU.

So basically they are the only country on the EFTA still, Norway, Iceland, Liechtenstein went on to join the EEA.

EFTA was never part of EEC, they are termed as the outer seven, after their 7 founding members which includes Britain. The Brits were indeed there, but they wanted to be part of the inner 6 or the EEC. No one forced them to come in. They joined at their own accord, as already pointed out to you. Cou...

That would be by far the best thing to do, no freedom of movement but having it as a trade bloc. Meats when the EC was created by 6 countries namely Germany, Belgium, Netherlands, Luxemburg, Italy and France , the intention was to create a single market and promote economic intergration. You cannot...

11 months. Utterly Preposterous.

Anyway there is a glimmer of hope, considering they have found the need to reply to your MP and acknowledged their shortcomings.

I am sure they will either issue it or ask for further documentations from you soon.

All the best.

Interesting isn't. When Meats' compatriot were rejecting having their biometric taken for the government's abandoned Compulsory ID Card scheme, i don't remember people insinuating they might be criminals, that is why the vast majority of Brits were rejecting the idea. There was a huge public outcry,...

I suspect the legality of the EEA Family Permit and the need for biometrics will be dealt with by the European Courts of Justice, in due course, or shall i say well overdue course. In the mean time, you will need to apply for it, and accept all the requirements, which i don't necessarily agree to. I...
