I dont know what more I can say really.

As Recital 25 and 26 states, UK when it was a member, Ireland or Denmark are not party to that Directive.

Yes I read it, but that separate directive does not apply to UK, Ireland or Denmark, it applies mostly to schengen states, so it will not assist you or your wife. Well unfortunately your interpretation is not correct.
As a result of Brexit, freemovement ends, however those who remained in an EU state exercising treaty rights as at 31-12-2020 retain their rights as related to that state and not the 27.

Your wife does not retain her freemovement rights to move around the EU. She only retain it as regards to Ireland.

If you are moving to Portugal, she will need to apply for permission for you both, unless she applies for and qualify for Irish citizenship.

The policy has changed several months ago, and there EU Residence card is valid until its expiry, provided you are registered under the EU settlement scheme, there is not even a need to exchange.

To the best of my knowledge, for your partner to qualify under the EU Settled Status Scheme, either the marriage needs to have taken place before 31st December 2020 OR the relationship needs to have been a durable relationship (a relationship akin to marriage, with shared bills and joint finances) ...

It will seem they are processing the most recent before the backlogged application made last year. So much for chronological, that they always talk about.

My view is to appeal, as the rules since June has changed to the extent that you will have significant difficulties succeeding in a future application.

Littler's views are sound and appears correct. It matters not that she was on a different permission that was not supported by the British citizen.

So long as the relationship was durable before December 31 2020.

I will advise, like Littler that an application is lodged as soon as possible.
