An application can still be made for late applicant, provided the delay in applying can be explained.

The treaty provides for late late applications with reasons.

Just out of Interest, are those receiving Permanent Residence documents receiving cards that simply says stamp 4, or does their card state it is Permanent Residence documents.

You have completed 5 years, so you can apply now. As regards citizenship, you cannot apply now, as you have been away for more than 6 weeks.

Best to wait till next year.

I complained about it, I asked them for the legal justification for requiring that at time of Permanent Residence, they said this is not their practice and not the law. It clearly is not the law, i am rather surprised they are still doing it.

A question for those who receive letters from Minister confirming grant of Permanent Residence.

Were you asked to go with your family member to the immigration office. This is for people outside Dublin.

Did the letter demand that you be accompanied by your EU family or not?

8 months wait is a stretch. I have had to wait for 6 months in a case i did in 2018, but that was because the judge was unfortunately deceased. I dread to say, that at the time of your appeal extended family members were not entitled to pre settled status, so it is likely the appeal may not succeed....

The judgement seems good, but not sure what Home Office will do.

I suspect pending applications will not suffer, but new settlement scheme application may be affected.

Underhill LJ is a decent judge. Lets hope he will do the right thing. Need all the Home Office applications before the Tribunal to fail.

2 issue may arise in this case.

1. Was the person as a matter of Croatian law a Croat citizen on the day of withdrawal.

Also, only those who have notheard residence permission in the last 4 or 3 years, as the case may be, will benefit from the scheme.

At least one country in the British isles is showing compassion and basic decency.
