I do not personally see what is wrong with that Judgement. Following Rahman C-83/11, states are required to promulgate legislative provision to give effect to Article 3(2). It is only dependent family member or extended who do not need to show they are dependent in order to maintain their status. However if you divorce, you will lose right to the presettled status and it could be revoked or curtail, unless you qualify in another capacity. 323(iii) of the rules permits ...

People on pre-settled status are permitted to claim benefits if their family member has a right of residence.

There has to be a dependency on the EEA national.

That is no longer the law. You may bring in relatives of your Non EEA spouse, provided they are dependent on you.
