It is sad you and your partner have to go through this situation. So far as spouse visa is connerned your spouse needs to have a valid visa at the time he made that application or the application is made in his home country. As the situation stands the best chance is to go home and apply from there....

If you are a family member of EEA national you pay the same fees as UK citizens.I dont think you have to live here three years before you enjoy home status fees. I went to university straight away after I received my resident card and having been here for one and half years.

There is no way your partner can cancel your ILR.It is an empty threat.Even Secretary of State cannot threaten you with cancellation.Once you acquired ILR you can only lose it if you stay more than 2 years from UK.Even that there is a process you have to go through

My appeal has been postponed to june because HO could not file and submit their bundle.It is shame that I provided mine to them and the court but they failed to do their part but asked for adjournment.I will update you the outcome
