If child was born in the UK after a parent has ILR, then child is automatically British. Child may apply for either a British passport or a CoE-RoA. Child cannot apply for a UK visa.

If her circumstances are the same as her last extension, then she may keep on extending, until she can rely on 3.2.

I think she requires at least a B1 level English Language for ILR. Else, She may extend her leave for a further 2.5 years.

Technically, the question is not applicable, if she had never been granted permission to stay as a partner. However, it may be prudent to disclose her living with you as a visitor, etc.

Having more leave than necessary is not a ground to refuse a valid and eligible ILR application.

However, if she did not have leave as a spouse under Appendix FM for the whole of her 5 year period, then she may be ineligible for SET(M).

They should have disregarded the 9 days overstay, if you had made a FLR(M) application and satisfied all the normal requirements under the 5-year route and provided a good reason for the delay of the FLR(M) application. As they were born in the UK, I think 306 also allows them to apply for ILE/ILR when one parent is granted ILR. But I suspect they may make excuses to reject these rules.

If mother has Indian citizenship, then I doubt the British Government will agree that the child is stateless.

They may also expect both mother and child to have ILR, etc., before granting British citizenship under Section 3(1).

Unfortunately, cannot apply for ILR from outside the UK. If travelling outside the CTA, then 34K treats a pending non-EUSS application as withdrawn. Don’t cancel. Unfortunately, if their leave have expired, then they are overstayers. However, this should not affect their entitlement to register. Before they are granted British citizenship, they may apply for entry clearances before returning to the UK.

Yes. A 22 year old adult may apply for Naturalisation independently.
