Re: Spouse visa refused on english test can we appeal

Yes, you can appeal the decision The issue is that the Home Office is only concerned with the Speaking and Listening results, the reading and writing scores is irrelevant as this is not required for spouse visa, therefore the overall score is not considered. You only need Level A1 and you are correc...

Re: KOL & ESOL for Naturalisation

Yes, your wife will need to take the ESOL test at Level B1.

You will need to get your degree certified by NARIC. Head over to their website for more information. You will also have to pay a fee (approx £55).

Re: ILR and returning to the UK after 2 years

Your ILR can be revoked and cancelled if you are away from the UK more than two years. I don't think there is any leniency on this rule. However, one way round it is to visit the UK at least once (say for a couple of weeks) within the two year period. This way, you won't exceed being absent for more...

Re: IELTS validity

An expired IELTS certificate is not accepted for a spouse visa. It is nevertheless accepted for settlement (ILR) and Naturalisation (Citizenship) purposes. More info here: http://www.immigrationboards.com/indefinite-leave-to-remain/re-expired-ielts-t150671.html However, just ensure you have a score ...

Re:

She doesn't need the B1 test, only the Life in the UK test as her visa was issued under the old rules. Have you clicked on Vinny's links? This is incorrect. You don't need a B1 test if you were applying for ILR before 28 October 2013. Applying after 28 October 2013 for ILR, you need both B1 test an...

Re: both on ILR, what happens after divorce?

You can always contact the UK Border Agency or contact an immigration specialist who will confirm divorce proceeding will bear no effect on someone who has ILR. Of course, a ILR can be withdrawn but under exceptional cases as to the one Amber has posted above such as leaving the UK for over two year...

Re: both on ILR, what happens after divorce?

Hi.

If your other half has indefinite leave to remain, then she is here on a permanent basis and can stay in the UK legally.

You divorcing her will not affect her entitlement to stay in the UK for indefinite.

Clarification for ILR Document Requirements

I read all the info on the UKBA website and searched this forum but just want clarification regarding cohabitation documents for ILR. In form Set(M), it states: We need 6 letters or other documents addressed to you jointly or in both your names. If you do not have enough items in your joint names, y...
