Hi, it's pretty straight forward make sure you have a good barrister and it shouldn't be a problem.
Although mine got dismissed on exactly the same issue in January then i applied for permission to be heared at UTT, which was granted and have hearing on the 17th of March.

He said 1 year for the case to be heard. he did not say 1 year for the date of the hearing to be fixed. Applied for permission 31-1-14
Permission granted 19-2-14
Hearing date allocated 21-2-14
Hearing date 17-3-2014
