Re: Paying Council Tax & Naturalisation

Good evening, I am staying with my friend at his flat. It has been nearly 3-4 years since I am staying with my friend. My question is in relation to paying/not paying Council tax bill. My friend is the owner of the flat. He pays the Council tax bill, but i am not paying it. Could please someone exp...

Re: Student loan

Perhaps get your EU citizen spouse to exercise treaty rights in a country that will give you free or cheap universtiy fees?

There is a list here from a US site.
https://www.student.com/articles/countr ... ee-europe/

You can google and find other EEA countries who do this.

Re: Financial requirement, self employed, benefits

But I'm not really asking to advise him on whether he should have gotten JSA, but rather for the immigration implications of having gotten it. And in the rules, it's clear you cannot count it as income, but it's not clear to me whether having received benefits is detrimental to a spouse visa. As fa...

Re: Financial requirement, self employed, benefits

I am also self employed and I work in tech and though I have a more steady income stream now, there were times in the past when a single two month contract could double my annual income, then two months of almost nothing. In many industries, when you're self employed, it can be feast or famine, wit...

Re: Financial requirement, self employed, benefits

How have you been claiming JSA if you are registered as self-employed? I'm asking for another person, so I'll ask them for details. I don't really know anything about JSA eligibility. A quick web search gives some results saying a self employed person may be eligible for Income Based JSA rather tha...

Re: Benefits husband and leave to remain

And your husband's name must go on your Tax Credit claim as you cannot claim to be single when you are in a couple, as that is benefit fraud. You will get less housing benefit as his income is counted in your claim. As CR001 said, you can't take extra housing benefit for him as he cannot take public...

Re: Child benefit on BRP

Child benefit has nothing to do with state pension. It does, as CB is one of the benefits that give the claimant a NICs credit towards a state pension if they are not working/earning enough to pay NICs. https://www.gov.uk/child-benefit/overview That's why those that have a spouse who earns too much...

Hello, My husband and I were granted ILR in May. We were wondering if we can apply for child benefit for our 8 year old son who has just been granted citizenship because he was born here. I see on old posts on this board that we would have qualified, but I don't see anything recent. On http://www.g...

Re: Irish national applying for permanent residence

But CTA is nothing to do with Brexit and I've not heard in media or forum that CTA is in question or under threat. There was lots about this in the Irish papers in the build up to the vote in June. Mainly about their fear of a Brexit meaning they lose the protection of the UK for Ireland's low corp...

Re: Brexit has screwed up our baby plans.

I am an non-EEA with ILR I apply for BC in Sept 2017. We have also heard of the massive costs and expenses of becoming a spouse of settled person, not least as he would have to apply under my old Tier 2 general category apparently. As you have settlement it would not be under your old Tier 2. It wo...

Re: Flr spouse visa denied. Help!

By virtue of Section 10(2)(a), OP would have paid for NHS surcharge when she made her variation application, and as a result, that provision exempt an Overseas visitor from the Recovery of fees provision. Are you saying that even though her fiance visa did not allow her to use the NHS for free, or ...

Re: Flr spouse visa denied. Help!

Petaltop what you quoted those people as saying is inconsistent with the 2015 order, and Section 39(1) which the purport to derive it from. These legal firms and hundreds of thousands of others if you search the internet, are all commeneting on the changes for who can use the NHS for free, made via...

Re: Flr spouse visa denied. Help!

Therefore my legal opinion and view is that, a person issued with a Fiance VIsa with a view to settlement, is ordinarily resident in the UK, Now read the Immgration Act 2014 on the NHS and how it changed the definition of "ordinarily resident". This NHS part started April 2015. Here is one immigrat...

Vinny, Thank you, in simple words what impact this will have? I have read it twice but not sure. " The direct precedent value of the case is therefore little, unless it does represent a turning point. " is what is said in that article, under the quote vinny used. They said this case was about the n...

Re: Flr spouse visa denied. Help!

So in your view petaltop, FIance Visa is not a settlement visa but a visitors visa? Is that correct. If it is, then i clearly don't accept it. That is not what the above quote from the UK government site says. The Immigration Act 2014 changed the defination of"ordinary resident" for free NHS, to Br...

Re: Flr spouse visa denied. Help!

, not even remotely and no free access to the NHS. Please ignore that advise. It is wrong and misleading. If a person entered on Fiance visa, they are permitted to use NHS. If they apply for settlement before their visa arrives, then section 3C will be engaged. Everyone can use the NHS but some hav...

I know, but I don't want to go back to America without my husband nor do I want to pay another huge amount for an application, for someone's mistake. It isn't fair. I've read your thread on another site. As you are in the UK on a (now expired) fiance visa, your terms remain the same while you wait-...
