The application form and guidance do not say that you have to show proof that you have private health insurance, if your partner is a student with an EHIC. You only need to provide her EHIC. You can only claim as a single person and get the single person rate. Your wife is not entitled to claim any benefits BUT her income (if she works) will be used in conjunction with yours to calculate what you qualify for. I don't suppose by any chance that your husband is able to claim carer's allowance for your son? With ILR she can claim in her name to get her NI contributions.
I believe that as you have been outside the UK for more than 12 months, there is a 3 month wait.

I'm not sure what you need to send, but that information should be on the claim form.
