Although I am not 100% certain, I have never heard the Kenyan Government not recognising such Marriage Certificates (as they are conducted in places officially authorised to conduct marriages (e.g. temples, churches, mosques, hotels). Indeed the British High Commission used to accept them previously...

Good to read that the man finally obtained BC. As the UK Government conceded, they were correcting a historic wrong by allowing BOC's to register as BC's. By the very nature of their BOC, these people are effectively stateless (no right of abode in the UK and no right of residency in the countries t...

Just following up from John's post, you may need to make sure that the marriage certificate is issued by the Government of India and not a temple or by the local community, e.g the British mission in Kenya no longer accepts marriage certificates issued by local community e.g. Visa Oshwal Community, ...

His case was complex, a bit like the rubbish, The Terminal. BOC passport holders no not have automatic UK residency, they could apply for settlement vouchers, he probably did not have one and was grilled at Heathrow about his intentions of staying in the UK. BOC's do not require visas to enter the U...

Curlz,

Could you share with us what happened at Heathrow? Your case sounds straightforward, so can't see any reason for a problem?

Kayalami, Is it really necessary to provide proof of accommodation for HSMP extensions? I was under the impression that this was not a mandatory requirement.

Has any UK MBA graduate obtained HSMP approval?

Has any UK MBA graduate obtained HSMP approval? If yes, how long did the approval take and what information/paperwork did you submit other than degree, bank statements, proof of accomodation etc?

John, just to follow on from your reply, the spouse can request for an NI No. interview and indeed apply for NI No. if she is actively seeking work (show job applications, interview invitations etc.). I don't think she has to wait until she gets a firm job offer.

Dinsey, I am assuming that you are a British Citizen? Your wife can only apply for ILR in June 2007 i.e. 4 weeks before her current leave to remain expires, so sit back, relax and have a good holiday in your wife's mother country.

Helena, why were you rejected in your first application? You can apply in country if you hold a valid student visa. You may not obtain points for your degree until you actually get it in March 2006, are you able to meet the minimum points required without the degree?

This appears to be the first case where HSMP extension is being refused outright. I guess it is important to show that your employment income is being taxed otherwise WP(UK) will not grant extension. It would be interesting to see how this case proceeds. I cannot see how someone whose income is not ...
