When my wife's FLRM application was refused a few months ago they returned all documents except the passport therefore you have nothing to worry about.

Bear in mind they won't return your passport if they refuse your application.

I was considering filing an application to the European courts of human rights but I decided not to and wait for the outcome of my reconsideration request.

I'm a little confused with the process, who is the main applicant ie the EU citizen or the Non-EU spouse?

Has anyone asked their MP to refer their case to the parliamentary ombudsman? It should get things moving a lot quicker as well as giving them a grilling. There is no excuse for HO to provide appalling levels of service like this.

I would put in a complaint to Home Office and wait 20 working days to receive a response. If you've not heard by then or are not satisfied with the response then contact your MP and ask him/her to put in a complaint to the Parlimentary Ombudsman. If you go down the Singh route, with the rules in place as they are, the only way to challenge them is through appeal - which (depending on how the Home Office are feeling) could be many many stages. If say my wife was granted discretionary leave would we then be able to apply for spouse visa? Why would you think she'd get DL? I agree with MPH80 regarding the discretionary leave. I can't see that an FLR(M) application would have succeeded as there was no valid leave to extend.
