Re: Surinder Singh advice needed

Three months residence is not enough as you will be judged on the lenght of residency. The centre of life test is no longer the only determing factor whether an application will succeed. Whilst is still a relevant factor, it is now part of the wider "genuine residence" test which takes into account ...

Re: Article 50 has been triggered. What now?

There is still a possibility the UK will adopt the Norway model if a free trade agreement is not reached in 2 years since no separate withdrawal notiifcation has been given under Article 127 of the EEA Treaty.

Re: why I voted for brexit

I hope Brexit will damage her and her partys chance of wining the next election. Like Margaret Thatcher, she may be polarising, but like her, she is also a case of TINA (There Is No Alternative). Neither Corbyn nor Farron nor Farage inspire any confidence. By definition (in the title of her party's...

Re: why I voted for brexit

I guess Mrs May was never cut out to be PM, infact she has proven to be one of the worst choices to lead the country. Her track record as Home secretary was appaling to say the least. We should have just stuck with Cameron. I hope Brexit will damage her and her partys chance of wining the next elect...

There is going to be a government White paper on the Great Repeal Bill which will be published on Thursday a day after triggering Article 50. It may provide more clarity on the governments position regarding EU Immigration. http://www.cityam.com/261712/theresa-may-reveal-plans-post-brexit-great-repe...

Reunification of the North with the Republic is just round the corner it seems and maybe more sooner than we realise.

Re: why I voted for brexit

Europeans have far more things in common with other Europeans than with South East Asians, I'm sorry It was people from India, Pakistan and Bangladesh which fought and died with the British during the World War to defend this country. What have the Europeans ever done for Britain that they suddenly...

Re: NEW EEA Regulation that violates EU law coming into eff

The charity BritCits has setup a donation site towards funding for a legal challenge in regards to the unlawful changes to Surinder Singh (Regulation 9 of EEA Regulations 2016).

There is a ray of hope the rules will be challenged.

Re: Surinder Singh route after March 2017

Also bear in mind that there may be an early cut off date for new EU national arrivals who will not benefit from permanent residency once the UK leaves the EU in 2019. That date may apply to Surinder Singh cases due to the fact that the British Citizen is treated as though they are an EU national.

Re: Supreme Court to hand down judgment in MM Case

Essentially the Supreme Court has opened up a loop hole with this judgment. If you don't meet MIR, have kids and then you can be granted entry clearance or leave to remain outside the rules. Whilst it is welcome the best interest of children will be protected, the rules are vulnerable to exploitatio...

Press summary and judgment . MIR and specific income threshold of £18,600 found lawful. However, rules regarding treatment of children and of alternative sources of funding will need to rewritten. Now that MIR has been found lawful by the Supreme Court, it is not improbable that the government may ...

Re: Supreme Court to hand down judgment in MM Case

There are more reasons for the Court to either lower the income requirements or obolish it altogether because approximately 50% of the UK population does not meet the requirement and it can discriminate against women in particular. Compare that with the English language requirement, it can be achiev...

Re: 137 Pages EEA application form, what for exactly

I don't think the EU Commision is interested or it is not powerful enough to enforce the law on member states. They promised infraction proceedings against the UK government to comply with EU law when the "centre of life test" was inserted into Reulation 9 and 3 years on its still there along with a...

Re: Brexit court defeat for UK government

If they go by that date then they are essentially implying that EU free movement rights ended on 23rd June 2016. That cannot be right since we are still a member of the EU for atleast another 2 years from the date Article 50 has been triggered and the Brexit date should be the date where exisiting r...

@ mkhan2525. It seems you didn't validate the passport at the Airline checking desk before going to the gate, that would have saved you the troubles. Talking from experience. That wouldn't have made a difference as the guy at the boarding gate did query with the Airline check-in desk and they didn'...

Re: Stamp 4 eufam holder visiting UK

There is no immigration when you travel from ROI to UK via air. Just book tickets and get the passport done :) its that easy and simple. Speaking from personal experience!! I beg to differ. Whilst there may be no immigration checks as such, arline staff are instructed at the boarding gate to look f...

Hi, many thanks! Sorry, I am not sure I understand- why it will be in our hands soon? Well in the courts I am sure people will then be able to demonstrate that the changes are indeed unlawful and binding precedent will be set which the SSHD will have to follow. I guess we will have to rely on a cas...

Re: UK Spouse visa refused. Reapply under Irish?

For freemovement purpoeses, a non-EU national does not necessarily need a passport to enter any EU country when travelling with the EU national as long as you can prove your relationship by other means as stated in Article 5(4) of the Directive. If you make it to Ireland your main hurdle will be to ...

Re: Family member of UK citizen SS route Ireland

Requiring the British Citzen to be a qualified person on return to the UK is contrary to Eind case law. One reason they could be asking for this information is to see if you would meet the income threshold to sponsor spouse on domestic route and that you didn't go to Ireland just to circumvent UK Im...
