Re: Permanent residence refusal

Without trying to discourage you. To win this case will be by miracle. But let's say your appeal didn't give you the result you wanted,my concerns now is, you're now divorced and if you both don't have child together you cannot have retained right. Your last option is after brexit date or whenever t...

Re: Guidance for permanent residence application

On the issue of renting. Assuming he has apply for his PR since December 2017, by now he would have got his Certificate of application which could have been useful for renting and his lawful resident in UK. But if he doesn't have it, then the only option is to use your house to make application.

Re: Guidance for permanent residence application

Just to assured you. Your case is not complicated at all and as you have pointed out, retained right of resident does not applicable to both your husband and his first daughter not until you are both divorce come what may! .Your separation was irrelevant under the EU law. .Your husband work activiti...

Re: Proxy Marriage - BR/IT

You don't need to marry twice but once you have done it Brazil, get letter from the registrar to proof the validity and possibly from your embassy in UK. Otherwise HO might decide to push you around a bit. If you want you may as well just register and interpret your marriage with Italia embassy anywh...

Re: Proxy Marriage - BR/IT

You will need to check with your country if marriage by proxy is legal? If the answer is yes, then you may proceed. Also you will need a letter to state from your country that the marriage cert is valid and legal anywhere is presented. Secondly, your half will have to come to UK to get work and use th...

Re: EEA PR refused and appeal or send a new application?

Still up til now many applications like yours were still going through refusal by same body. Some was given appeal and some don't why by asking them to provide their ex wife either passport/ID after divorce when they've got retained right of resident without providing the ID how does that sound sens...

Firstly, I will like to commend your effort by taken those hostile body and their representatives on! Congratulation. Normally your PR date should/will be your 5th yrs of your marriage/combination and forget about your period of appeal. However because they are such an evil elements (some caseworker...

Re: EEA Family Member. Retention of Permanent residence

Base on that specific date you have provided that she left and she wants you to divorce her asap. Presently in the UK divorce procedures do take at least 4 months to complete depends where you are in country. To your question. In order to use 2 yrs desertion, you may double check with local authorit...

Re: EEA Family Member. Retention of Permanent residence

As Richard has pointed out to you. Technically she's been out of the country since around December 2016 and to proof her presence in the UK during this period might be a difficult task for you. Also herself will loose that PR if only she's out for complete 2 years at ago. Google EEA REGULATION 2016 ...

Re: ROR IN APPEAL

Happy for you.You can apply if it's 5yrs you've lived in the UK. Just provide the paperwork that shows your ex spouse was exercising treaty right from marriage till divorce follows with yours from that date/month to be able to qualify for PR. However you may then need to explain why you can't provid...

If you have been going through domestic abuse, have left your half, i e divorce or you're still trying to? If the answer is no then you still need to sort yourself out before your 5 RC finishes by applying for retain right of residence to complete your journey with evidence of the abuse you've state...

Re: EEA wife works at my firm

In my view, once the business is consistence and legit you have nothing to worry about. The only problem ahead might be issue of providing employment paperwork ie wage slips,Ni contributions and method of payments for not just for her but for the 3 employees as you've said in your post. Although the...

You may be fine at the discretion of the HO if it is still valid at the submission of the application. But if I will advise you, try to get the renewal possibly before the caseworker decide on your application and send it with your case ID number. In case they ask you to provide the valid one What d...

You do not have to apply for anything as an Irish citizen as you're treated as a settled person due to agreement between UK and IRELAND. You are not even counted as part of immigration from EU due to the agreement and uptil now is still in place. Same apply to your husband if he chooses to stay on I...
