Mr Rusty, John, Vinny & others: Did any of you get the chance to read the determination? If you did, is my understanding in the above post right: Residency is considered continuous if leave did not expire before a new leave was obtained abroad if the absence (6 months and total 18 months) was not b...

Only periods of "residence" count for the 10 year ILR. Being in the UK in a visitor's capacity does not amount to residence. You did not reside in the UK you had merely visited it. I did have residence and not visitors visa. I switched from one category to the other (WHM to Student) at that period ...

Hello I am an ILR holder with a H1b work visa for USA on my current Indian passport. I qualify for naturalization as a British citizen. Does the above also mean that the BIA cannot deport overstayers they come in contact with until such time as the date or this is just for overstayers under the radar alone? I am just thinking if the above is correct, then BIA cannot come and knock on your door in the night. You would have to tell th...

The entry clearance as a single parent is subject to the same provisions as other entry clearances for periods of at least one year. I confirmed this early on. They can interfere for at least 1 year without fear of Article 8. The in-country application for single parents was always subject to the c...

Do you mind if I run this by you once more? May 19th '08 will mark 23 months since my arrival, I can then send in my application for ILR. Hopefully that will come back successful and once it does I can immediately write my citizenship test . If passed, apply for citizenship? . I am afraid you would...

Let me just say that your situation is not good. What you should know is that, if the company has been reported bust to the BIA then they will know. You have two options and I will lay them down for you: - Make a SAR to the BIA to see what info they have on you. If there is no mention of your compan...
