Re: Question about residency requirements

Not really, no. That line didn't tell us the timeline of their parents wedding date (which we now know is July), or where that took place (which we don't. Was it in the UK or abroad?). We still don't know when the mother arrived in the UK, and on what type of visa/permit.

Re: EUSS application for family members

Also, it doesn't matter if the family members never applied for pre settled status, if they had Pre-settled status and lost it, or if they never resided in the UK. What matters is the status of the sponsor. As long as this is still valid, the sponsor and can bring new, "joining family members" anyti...

Re: EUSS application for family members

None of the family were residing in the UK on 31 December 2020 (23:00hrs)? That was the key data to have qualified for (pre-)Settled Status Not really. The key is that the sponsor needs to have started a period of residence before 31 December 2020 , and since then, either 1. Have acquired Settled S...

Clearly on their wedding date, so July 2019.
Assuming that she was already resident in the UK before the wedding of course.
Indeed. I Hence why I asked the OP for specifics on their and their parents timeline.

Re: Question about residency requirements

The residency will count from the time you became the step-child/family member of the EU citizen. As the EU citizen married your mother in 2019, your residency clock for the purpose of Settled Status will start from the date of marriage of your EU step-father and your mother. Your mother (assuming ...

Re: Question about residency requirements

Because I called the EU Settlement Scheme twice and got two different answers each time, one said what you said and another person said if I can provide evidence I was there in the UK in 2018 (with the usual stuff like bank statement), then they'd also count 2018. I have lost count of how many time...

Re: Surinder sing route

Usually, same evidence presented for family permit, plus proof of residence in the UK. For proof of residence, If applying within the first month of residence, usually entry stamp or boarding pass is enough.

Re: British Citizenship application

Thanks. My understanding was all documentation (including referee declarations) were to be uploaded while submitting the application online, after payment - which was why I was confused. If it can be submitted a month after the application, am I right in assuming this then means there is a time per...

Re: Nationality of child born in the UK

Also, Mexico allows dual citizenship, so the child does not need to surrender their Mexican citizenship, and is of course allowed to have two passports at the same time. Mexican passport does NOT mean no British passport. Where is all this analogy coming from. Seriously, I'm mighty confused now. Ar...

Re: Nationality of child born in the UK

All I'm saying is, the child does not need a visa just because, and if, they get a Mexican passport. That was the question, and the way you answered it could be interpreted as a "yes". Precisely because the OP clarifies there is no intention to travel, there is no need to be saying they'll need a vi...

Re: British Citizenship application

Thank you, that's very helpful. I'm not sure what you meant by either side of the application date but I take it from what you mentioned that submitting the application within a period of 3-4 months from when the declarations were signed should still be okay. Solomon I think he meant referee declar...

Re: Nationality of child born in the UK

If child gets a Mexican passport, you would need a residency visa for the child to (exit the UK and be able to) return. Otherwise it gets messy at the port of entry as Mexicans don't need a visa to enter the UK. There would be a lot of explanations required. Always nice to avoid that. I think you a...

Re: Can a naturalised British citizen be a referee?

Thanks everyone. I have agreed to be a referee, and I believe my being a naturalised British citizen will not be a problem. I'll report back when the application is approved, for the sake of documenting it, and for future reference.

They were confused and definitely overthinking and misinterpreted something.

There has never been such a requirement. So no rule change or anything either.
Thanks, CR001. Clears it up!

Re: Forgot to add applicant name on referee declaration form

I empathize with this, as this almost happened to me. It's easy to miss since they don't highlight the line were you are supposed to fill in the applicant name. It was my referee who pointed it out! From other posts it seems that when a referee is found not to be suitable, they inform the applicant ...

Re: Can a naturalised British citizen be a referee?

Thanks. I remember my friend saying it was a struggle to find referees because they had to be born British. This was 2018, I think. So either she was confused, or that was the rule at the time, and it changed? I really can't find anything on it, so I am just assuming she was just overthinking it, un...

Re: EU Settlement Scheme - Settled Status rejected unfair rules

I moved to the UK in 2017 and held a Tier 2 visa. In 2020 I switched from Tier 2 to EU settlement pre-settled. I applied to settled status this year because I thought that I had 5 years continuous resident in 2022 because I moved in 2017! Yes, this is a very common misinterpretation of the text fro...

Can a naturalised British citizen be a referee?

From the wording of official guidelines, it seems to me that as long as one is a British passport holder, and, of one of the accepted professions or over 25, one can be a referee regardless of the fact one is a naturalised citizen. In other words, there is no requirement to have been born British to...
