Have you lived in the UK as the spouse or durable partner of an EEA citizen?
Given the OP has already pre-settled status and their BRC is expiring soon, I am pretty much assuming the answer to that is yes... (but hey you never know  ).

Re: Switch pre settled status to settled status

After calling the resolution centre I'm being asked now to send the application through post. is that the case for such cases? Yes, you are a Lounes case. That is, family members of British citizens who were previously EU citizens and had status under EEA rules or the EU scheme before becoming Brit...

Re: Irish citizen got pre-settled status, yet is considered settled in the UK by law?

I guess I’m trying to figure out if she needs to renew her status in 2024 so that I don’t have any issues renewing mine in 2026, or whether this is all a non-issue considering the court ruling. Difficult to tell how straightforward the process would be if he does not "renew", but as of today, upgra...

Re: Irish citizen got pre-settled status, yet is considered settled in the UK by law?

Appreciate everyone’s responses and thoughts about the situation. I think we’ll just chalk it up to a mistake cause in my mind there’s an inconsistency in her status as being both settled (by citizenship) and pre-settled by their judgement. Keep in mind this is a non-issue. He is Irish, and he does...

Re: Irish citizen got pre-settled status, yet is considered settled in the UK by law?

When my Irish citizen spouse applied for EUSS back in 2019, she got pre-settled status. As an Irish citizen, she didn't need the status, but only applied so that I (Canadian) can also apply under the EUSS. Not directly answering your question, but on a relevant tangent: Your spouse having Settled S...

Re: Can I apply for a settled status now despite these discrepancies?

Are you absolutely sure, that one can apply for a femily permit in any country. Please note the answer above refers to the now-defunct / now-unavailable EEA family permit. For that, yes, I am sure it was possible to apply in any country. I know one can apply for a EU Travel permit from abroad, and ...

Re: Splitting from my EU partner. Unmarried partner.

My understanding is also that the Pre-Settled Status will be valid for 5 years and the BRC card will be valid until its expiration date, regardless of whether the relationship has ended or is subsistent. I'd like to add that, because you are unmarried, there is no immediate way of establishing that ...

Re: When did you first arrive in the UK to begin your residency?

Just answer all questions truthfully. If you arrived in the UK in 2012, then answer 2012. They will request proof of your relationship, and it will be clear from your marriage certificate that your residence as a EU family member started in 2018.

Re: Non-Eu child of primary carer with EUSS limited LTR

@kamoe, the OP may have misinterpreted this guidance from June 2022 , which allowed Zambrano primary carers under certain conditions to regularise their status under the EU Settled Status in a six week period between June and July 2022. Right. Thanks @secret.simon, that does add some more legal con...

Re: Non-Eu child of primary carer with EUSS limited LTR

You have applied under the EU Settlement Scheme as a “dependent person with a Derivative right to reside”. However, you are unable to qualify on this basis because a person only has such a right to reside if they were resident in the UK on that basis at 23:00 GMT on 31 December 2020. I'm afraid thi...

I have been granted EUSS limited leave to remain as my first son is an Irish Citizen. However, my second son, a non-Eu citizen, has been in the UK since December 2021 and applied to the EUSS. This application has been refused because he was not in the UK before 31st December 2020. Can you share the...

Re: Can I apply for a settled status now despite these discrepancies?

I needed a visitor's visa because I didn't apply for a EEA residence card in the UK at the time. You did not need a visitor's visa. You could have applied for a Family Permit in any country; to gain entry back in the UK, which was free, and was usually treated in priority. For this you did not need...

Re: Can I apply for a settled status now despite these discrepancies?

In 2019, my immigration advisor advised me that since I wasn't qualified for a settled status that I should use my last travel entry into the UK, not my first entry exercising my EU right of free movement. That it doesn't matter since I was not qualified anyway. If the purpose of this application w...

Re: Switching from Pre-Setteled to Settled when wasn't on pre-settled for 5 years

So if I had stayed on a Tier 2 Visa I could have now applied for ILR? Yes, but on a much, much more expensive route. But because I changed status to pre-settled I need to wait another year?? You just need to wait until December 2023, which is 5 years after you acquired your Portuguese nationality (...

Re: Pre-settled to settled status - exact time to apply?

Is it the day I first came to the UK? Yes. The day you first set foot on UK soil. Of course, you need to prove this, not sure if you still have your old boarding pass, as I imagine you didn't get a stamp on your passport on arrival to the UK? If you can't prove your fist day, whatever earliest day ...

2. My spouse clock started when we started living together, i.e. from Oct 2018. Take this with a pinch of salt. We've seen several examples of the EUSS helpline giving clearly wrong information to people, I would be really surprised if your spouse's clock truly started on moving-in date. My guess i...
