Does a period on ESA count as "retaining worker status"

With reference to either the 2006 or the revised 2016 EEA regulations, article 6: (2) A person who is no longer working shall not cease to be treated as a worker for the purpose of paragraph (1)(b) if— (a) he is temporarily unable to work as the result of an illness or accident; would a brief period...

Re: Interpretation of "having been employed in the United Kingdom for at least one year"

One year in this context will be the anniversary of the date you first started working in the UK. That does not mean only period when you were physically employed. A period of jobseeking following involuntary unemployment having worked for a certain period, or period when you were unwell are all ad...

As she's been in UK since 1993, she'll have to apply for a DCPR; then she'll be entitled to UC.

Re: EEA PR employment gap

On another immigration forum I'm part of, UKCEN, they advise that gaps in employment of up to six months, whether you were in or out of the UK, are fine - given once you have worked in the UK, you retain worker status for at least six months, sometimes more. A number of people with multiple gaps in...

Interpretation of "having been employed in the United Kingdom for at least one year"

For the purpose of obtaining a DCPR and with reference to: - Universal Credit guidance (see C1392 p. 17) and - The Immigration (European Economic Area) Regulations 2016 (reg 6(2)(b)), how should the fragment " having been employed in the United Kingdom for at least one year " be interpreted? Is that...

Re: EEA PR employment gap

Yes, some have successfully got PR, some not. If you look at some earlier posts (maybe 1-2 years ago) you'll find some of these cases. It all depends on the caseworker, but, strictly speaking, you have to prove 5 years without gaps. https://www.immigrationboards.com/search.php?st=0&sk=t&sd=d&sr=post...

You can have gaps of up to six months in any one year of the five - without needing to give any evidence of what you were doing.
Where do you get this from? It'd be good for me, though.

Away from prying eyes, govt stitches-up EU settled status system

A worrying article here: http://www.politics.co.uk/blogs/2018/11/05/away-from-prying-eyes-govt-stitches-up-eu-settled-status-sys There's been a little-noticed move by the government on the post-Brexit EU migrant system, which suggests - contain your surprise - that its promises aren't worth the pape...

If you have been in the UK for 5+ years, just apply for a PR card. It costs very little and secures your residency.

Guess what impact Brexit has on an EU national with a PR card. Yeap. Zilch. Nada.
Just shows you have no clue of what you're talking about.

Can you give us a TL;TR?

And does it mean the settled status is now enshrined in law? I'm still not convinced about it.

Re: WHAT WILL HAPPEN TO PERMANENT RESIDENCE AFTER BREXIT

The so called Settled Status is just a political promise and it is not enshrined in law. So far it was tied with the destiny of the Withdrawal Agreement, and we all know we're probably heading towards a No Deal. We have a promise made by a soon to be removed PM of going on with the Settled Status, b...

I have no doubt that Rees Mogg’s letter is merely a bit of sabre rattling in the war of political divisions now existing.
It's safe to assume the worst. Murphy's Law applies to Brexit, too.
