Re: Brexit better for non-EU migrants

It *may* still be possible to enter the EEA through another country and then move on to the UK via Surinder Singh, but one will first have to meet that other country's domestic laws. The literal wording of Cameron's deal says that this will not be possible for spouses who did not come to the EEA be...

Re: Brexit better for non-EU migrants

Remember that EEA immigration will not cease if we exit the EU. EU citizens will just have to apply on the same basis as British citizens when it comes to applying for jobs and bringing their spouses and fiancées in. It won't be a matter of right, it will be a matter of applying, meeting requiremen...

Re: Brexit better for non-EU migrants

Why are students included in this list? Surely, in theory, they are now just long term visitors, and the net influx of students should be zero. Anyone staying over 6 months is counted. They are supposed to go home, sure, but they have more than a temporary visa. Don't ask me, that's just how it's c...

Re: Brexit better for non-EU migrants

You need to lose the 'EU citizens help the UK' attitude. We don't, not unless we are doing a job on their skills shortages. I understand why we all want to live in the UK, but mass migrtion does not help a country. That is ignoring all the other benefits of immigration beyond merely filling in skil...

Re: Brexit better for non-EU migrants

I would be extremely chary about espousing the views expressed by ryuzaki in the past few posts, because they validate the Brexit point of view pretty exactly. As I understand it, he is offering the EU as a system of governance which is an alternative to the one in Westminster. if you do not like a...

Re: Brexit better for non-EU migrants

What a Brexit will mean is that the pressure will be more evenly spread. Currently the force of any downward pressure falls entirely on the non-EEA immigration population. Leaving the EEA (it won't be a case of just leaving the EU) will allow that pressure to be spread wider and thus likely easing ...

Re: Brexit better for non-EU migrants

The discussion has mostly been about people using SS to bypass the UK citizen's requirements (income/savings), but what about people wanting to bypass the non-EU spouse's/parent's requirements, such as the English language test? It seems like even if we stay, it's likely that the non-EU citizen will...

Re: Brexit better for non-EU migrants

Things won't get better for non-EU people wishing to immigrate after Brexit. They will get much, much worse. People voting to Leave expect really huge reductions in numbers. The government promised "tens of thousands", and will be held to it. Currently non-EU immigrants are around net 270,000, so ev...

Re: New EU deal: Free-movement rights gone?

Any thoughts / opinions / pointers as to what may happen if I accelerate our plans to relocate to May of this year and apply for residency before the UK referendum Decision? It seems like applying before the referendum would be a good idea. At least that way you know what the rules are. You can alw...

Re: New EU deal: Free-movement rights gone?

That would be the dumbest thing ever. Marriage before both spouses take up residence together is the complete opposite of marriage of convenience. Thank you for answering my questions. I understand what you're saying now. I can't really understand what the point of it is, personally. Surely anyone ...

Re: New EU deal: Free-movement rights gone?

The idea is to have UK spouse turn into UK/EU spouse visa - no discrimination. At the moment most people failing the financial requirement in the UK would probably pass it in Ireland which would move to an Ireland/EU spouse visa. Even putting the financial requirement aside the Irish system is much...

Re: New EU deal: Free-movement rights gone?

If they don't do this, well then they have just killed free movement for a considerable number of people - it's anomalous situations like this that made them draught the free movement laws the way they are in the first place. I would hope that when(if) the new regulations are brought in, there will...

Re: New EU deal: Free-movement rights gone?

We haven't found a flat yet so I highly doubt we would be able to apply for the RC in time and it would be a huge risk we aren't willing to make. I just don't understand why I wouldn't be allowed to exercise treaty rights if my EU spouse has never lived in the UK or EU. Because the UK is full of xe...

Re: New EU deal: Free-movement rights gone?

Thanks Richard, finally a useful post among all the political stuff. This is still a matter for negotiation. The European Commission has proposed bringing forward a legislative proposal to reverse the Metock judgment and prevent non-EU nationals from acquiring free movement rights simply by marrying...

Re: New EU deal: Free-movement rights gone?

How would this affect non-EU nationals who manage to get permanent residency in an EU country? Say I, a British citizen, moved to an EU country with better immigration rules and then my non-EU wife joined me and received some kind of permanent right to stay in that country. Could she then come to th...

Re: New EU deal: Free-movement rights gone?

Questions of abuse have always been a component of EU law. See https://www.freemovement.org.uk/abuse-of-eu-law-and-surinder-singh/ It's the second part where they talk about people circumventing the home country's immigration laws. That's the main reason people go this route, and would seem to talk...

Re: Non-EEA spouses excluded from EEA-route under EU-UK deal

Switzerland is a good example of what the UK will be like outside the EU. They are not allowed to sell most financial products into the EU because they don't follow EU rules. They tried to negotiate something, but the EU just said "sign our rules or go away". That may be the best outcome for us. The...

Re: Non-EEA spouses excluded from EEA-route under EU-UK deal

Being only a draft I would assume that the intent is to write a final text that includes DR. The bit about third country nationals with no prior lawful residence in a Member State is the most worrying part. It closes off a large part of the EEA route. It appears that you would have to find an EEA co...

Re: Non-EEA spouses excluded from EEA-route under EU-UK deal

Maybe the best result then would be for the UK to vote out, and the EU to ditch the proposals. Then I move to Scotland which becomes independent and re-joins the EU.

It's unfortunate when British citizens are forced out of their own country because of extreme xenophobia and lovely.

Re: Non-EEA spouses excluded from EEA-route under EU-UK deal

In some ways it might actually be better for people using the SS route for the UK to exit the EU, since it is unlikely that treaty rights would end immediately. If they did 2.5 million British citizens would be forced to return to the UK, many of them to claim benefits due to being retired or unempl...
