Still waiting. Can't seem to contact the HO for an update, they just say we have to wait.

Is there a phone number you can call for updates on your application? When you call the number on the HO website none of the options are right and it just says "wait at least a month". Well since they have all our ID cards and passports that's making life pretty difficult and we need them back ASAP...

You dont need to send passport unless they ask you to. Its scanned when you go to give in your biometrics and you take it back straight after. Is this the right thread? My spouse is applying to the EU Settlement Scheme as a non-EEA citizen. The application form said they need her passport as ID sin...

How long did you have to wait after applying to get your passport/ID card back?

I need to travel and my spouse needs to register at the GP etc and the HO has her only forms of photo ID.

EU Settlement Scheme Family Permit is for people with partners who are also applying under the Settlement Scheme. Because your partner is Irish they don't need to use that scheme. "Why are you returning to the UK" - trick question?

I see that the SS route settlement scheme form asks why you are returning to the UK. Is this a trick question? Using the SS route it doesn't seem to matter at all why you are returning, legally speaking.

If I put "Brexit uncertainty" could that be a problem? Or "FOM may end in October"?

Yes, so you are not an EEA citizen, and your wife is. So your wife is exercising treaty rights (Freedom of Movement) and you can apply as her spouse I think.

Family members after applying for pre-settled status

The children of non-EU family members can apply to come to the UK under the EU scheme. What happens if the non-EU family member applies for pre-settled status?

In that case can the children still use the EEA route?

As long as you have proof that you applied (e.g. a tracking number for the letter) you are okay, even if the temporary stamp on your passport expires. I was told that explicitly by the treaty rights division and the local Garda.

Just hold on, they are very slow I'm afraid.

DJ_goodfella, did the acknowledgement letter give you a deadline for a decision?

If you applied in September the deadline should be this month (six months from application).

Always worth paying the extra to get a signature on receipt, then you have proof that it was delivered and they can't say they didn't get it. If they lose it or don't process it in time that's their fault.

To exercise treaty rights you either need to be working or show that you are self sufficient, i.e. you have enough money for yourself and your husband without relying on the state for benefits etc.

Basically you need to move over there, for work or if you have sufficient savings and other income to be self sufficient. You can apply for a visitor visa for your GF before you go, as long as you have documentation showing you will exercise treaty rights (e.g. employment letter with start date etc....

INIS are swamped at the moment and you won't get far by email. Weeks or months to reply, if they even bother since you don't have an application with them. What do you need to ask them? Got a confirmation letter today. Decision due by 12/05/2019.

They also asked for some documents I had already sent. They even listed them in the list of documents I had already sent. I'll send them again anyway.

I just emailed INIS. They sent an automated response stating that acknowledgement letters could take up to 12 weeks and current processing times are 10 months.

My understanding was that the EU rules require a decision in 6 months.
