I have now received a letter from the Irish Naturalisation and Immigration Service (Dept/Justice). The letter is from Kevin O'Sullivan - The Principal Officer in charge of Immigration Policy. It took a little over a month to receive this letter - the text follows: The position is as you state in you...

Sorry for the lack of updates on this - I was finally away on Honeymoon with my wife :d I have got a response from the Dept/Justice which confirms that the Irish interpretation of the law is incorrect(ish) - I am just home, so I will post the full text and my next steps later on Monday - sleep is ne...

SOLVIT have asked for copies of our passports and marriage certificate so that they can move the case forward with the Dept/Justice.

Fingers crossed we may get some progress on this in the new year!

Ok now I am starting to understand - Is the EU person a citizen of Holland but resident in Ireland? Are they applying for their Nigerian spouse to join the EU spouse in Ireland? Also this issue isnt really to do with the EU1 visa - you should perhaps make another thread for it - so this one does not...

Dept/Justice EU1 Problems? Guide to dealing with them.

This guide is a work in progress based on my experiences with the Department Of Justice in Ireland. It may not be fully correct, but I will update it as often as possible when I get newer information. This guide specifically applies to EU-1 applications for non-EU spouses of EU citizens. It may be a...

kab118 - I first of all asked the signpost service - this is a free legal advice center designed to help EU citizens correctly interpret their rights. They confirmed that the Dept/Justice was not correctly interpreting the EU Directive. From there the first port of call is the SOLVIT service whose m...

Babstar - I am British and the EU citizen in this marriage. I have tried the British Embasy in Dublin, but there is not a lot they can do to alter the national laws which are the problem in this instance. Its the Irish interpretation of the EU directive which is at fault - I think the civil servants...

Great work! Your posts bring a huge smile to my face! I am using SOLVIT to see if i can force the Irish Govenment to more accurately follow EU directives. I also considering using the same agency to chase up on this crazy 'in person' application for Schengan visas. The more people who hammer away at...

Update on ONE YEAR GNIB CARDS. Last week I sent my question regarding the legality of the Department of Jusctice decision to grant my wife a one year residence card/permit to the Europa Citizens SignPost Service (1). This is a free legal advice service for EU citizens who feel that a Govenment body ...

Kab118 - If they do give you a ONE YEAR stamp, then they are acting incorrectly, and you have grounds to complain to various authorities to get the 5 year one issued.

The one year stamp can be renewed for a 3 YEAR stamp directly by the GNIB, you do not have to reapply to the Justice Department.

It seems that the Justice Dept have taken the following lines from the European Communities Regulations 2006 (http://www.justice.ie/80256E010039E882/vWeb/flJUSQ6PEJJ7-ga/$File/2SI226of2006.pdf ) (2) These Regulations shall not apply to a family member unless the family member is lawfully resident in...

Hi Scrudu, Its seems from a conversation with the immigrant council - that the Justice department is not following through on its requirement to give 5 year residence cards. Instead it is giving a one year stamp 4 - which allows the GNIB to give you a one year residence card - with a followup 3 year...

Hi Scrudu, You suspect that this is not a correct residence card? Im growing more and more confused by the day on these issues!?!?!? The letter from the Justice Department seems to indicate that we do not have a residence card - and that one can only be issued in the event that my spouse was already...

Its not really a free visa, if travel/work/time costs are added up. It would be so much simpler if EU member states would just accept ONE stamp in the spouses passport proving that they are an EU citizens spouse. This running backwards and forwards is a joke - and the opposite of the spirit of the d...

Hi Scrudu,

I have checked what you said - and it seems to be correct. I will not attempt to transit through the UK with my wife and no EEA Permit.

I'll post how it works when we go,

Thanks,

Johnsienk - have you applied successfully for a schengan with the reduced set of documents?

How do you deal with the embassies insistance that more is required.

Do you have to send the fullset on the condition that you will NOT be travelling with your wife?

I wouldnt worry about the letters - I sent 5 or 6 of them, and 5 or 6 faxes, and called about 40 times.

I also sent one really bad tempered e-mail - but I dont think anyone there actually reads e-mails.

Start calling at 10 and just keep redialling - eventually you will get in the queue (after about 30 tries) then wait the two or so hours and hope they pickup.

I was hungup on many times - even after two hours of a wait - you just need to keep trying.

If you are applying for a Shengan Visa under the spouse category did you send:

* Bank statements
* Payslips
* Travel Insurance
* Letter from employers
* Invitation letter

The form seems to indicate this is for non dependant applicants?
