Especially how did you responded to that, what documents you sourced from doctor or school. Please advise. Many Thanks Hi wahabishtiaq , I went to gp and ask about letter and they gave...

Re: Long Residence (10 years) SET (LR) applications

Dear hhe, I feel sad reading that the almighty UKVI has sent you a copy of their most recent response to most application. This totally unfair on applicant. It seems to me that the good for nothing people working in this government department literally issue this template letter to vulnerable appli...

Re: how long acknowledgement takes if apply by post for ILR

Hi,

I sent mine on 7th and haven't received any ack or BM yet.... Think Aug is mostly holiday time and less caseworkers available.... Hence the delay. Or Seniors may have another thought...

Re: Few technical questions about AR/JR/Appeal rights

Hi, I had same confusion and after reading the IA 2016 in detail and i interpret that right of appeal section is updated only for HR appeals where first tribunal has refused the claim. It also has extensions to stop illegal people from working in UK and driving etc, also people with primal criminal ...

Re: Varying ILR SETO TO ILR LR...Please help!

Thanks for reply, But i would appreciate if you could guide people in right direction as a lot of people are looking up to your guidance.. 3C leave is extended until AR is concluded which then extends it to next AR if allowed and ends once AR options are exhausted. Secondly my tax issues were amende...

Varying ILR SETO TO ILR LR...Please help!

Hi, I had my SET O refused on 322(5) due to tax amendments, My leave was expired(12 June) and refusal letter was sent (29 June) after visa expiry and had 14 days for AR, which has been submitted on 12th July. Now my AR is pending.... I had been in country for more than 10 yrs an had option to apply ...

Re: 10 Years LR application no appeal rights

The cases on hr are very strictly observed and scrutinised.... In most cases there is no hr on 10 yr route. HR cases are complicated and hence chances are low on 10 yrs lr. IMHO 20 yrs of residence or kids older than 10 yrs old will have leg to stand in court. Don't be fooled by misconception of 10 ...

Re: 10 Years LR application no appeal rights

This states that where the HR APPLICATIONS were refused and appeals were logged in court against the decision, the applicant will be deported first and then appeal could be heard in their absence. There is a lot of difference to what you subjected the post to what it really is... Hope this clarify t...

Re: ILR Admin Review- 322(5) Cancelled

Hi TechBro It's unfortunate and wrong too because 19(i and j)are related to earnings' genuineness of self employed. Which means they doubted your earning for current application. And they should have at least asked you if they had any doubt. Any idea how long JR hearing takes? Did they replace 322(...

Re: Tier 1 refusal and ILR LR application

Thats helpful, it means i can let them know about my 10 yr legal right on the address they will mention in the letter and also apply SET LR. All of my original documents are in HO so have to apply the LR without those documents and have to get solicitor to get some legal advise and covering letter t...

Re: Tier 1 refusal and ILR LR application

Just an update i have submitted my AR online today but couldn't add any new documents i.e SA302 paper adjustment for tax amendments which becomes reason to base that i am not dishonest. Now i am confused if i can submit new application for ILR LR based on 10 yr lawful residence? If i do would my AR ...

Re: ILR Admin Review- 322(5) Cancelled

Hi, Removing 322(5) is a good news. I think in this case you can file a new application with detail explaination on your tax issues. I have submitted my AR online, but there was no way to submit the documents that show that my amendments were done. I was refused on same 322(5) for not declaring inco...

Re: Tier 1 refusal and ILR LR application

Thanks Sadi I appreciate your response. I am confused as AR is under very strict timeline and guidelines. If I submit fresh application for ILR in same category then my current visa is expired on 12 June which makes it more difficult according to my understanding as if I get refusal on same 322(5) s...

Re: Tier 1 refusal and ILR LR application

There is possibility of refusal, but if tax was amended before application and evidence can be submitted then that could grant ILR provided a detail explaination is given. Also if refused there will be right of appeal unlike current situation. The point is am I allowed to submit a new application in...

Thats a great piece of work you shared. I am also victim of 322(5) and going to apply AR in next couple of days.

It will be good to hear if anyone has a success on AR or JR with similar cases?
