Re: ILR in 2018

Once you complete 5 years on Tier 2, you can apply for ILR. Actually you can apply up to 28 days earlier than completing 5 years on Tier 2. At that point, you will require a letter from your current employer stating that you are required for the foreseeable future. It doesn''t really matter as to wh...

Health Surcharge refund

I remember reading here a while back that someone got their Health Surcharge refund but I am not able to find the thread where a the contact information is given for applying for refund. I'd like to try my luck. I paid £600 for my health surcharge when I applied for my Tier 2 extension in July 2015....

Re: Wife and sons correct extension for ILR

OK, here is my understanding working out your case. Anyone else who thinks I got something wrong, please correct me. (My personal experience is only of Tier 2 and ILR, and dependants being on Tier 2..) if your wife switches to FLR(M), then the total fee would be: £993 + Health Surcharge for 2.5 year...

Re: Wife and sons correct extension for ILR

If you continue to apply for PBS extension and in the meantime your wife completes 10 years, you can apply for ILR for her I believe. And it will cost you less to get PBS extension than switch to FLR. I am not sure why has this not been pointed out. ?

but once wife completes 10 years here, she should be able to apply for ILR based on 10 years legal stay (unless FLR categories are excluded for some reason ?)

Re: ILR based on Tier 2 questions

Thanks CR001. I do have 2 dependants (wife and son) and they will only complete their 5 years in 2021. My wife had her first Tier 2 dependant in June 2013, but unfortunately, it expired in July 2015, and we did not renew it then. She spent her whole pregnancy time in home country and then child was ...

ILR based on Tier 2 questions

Dear all, I have my appointment next week, planning to apply for ILR based on 5 years of working on Tier 2. I just want to make sure that I have got everything in order so if you could kindly let me know if I am missing anything or anything else I need to take care of, before the appointment: I have...

Re: ILR and employer absence letters

Can you please clarify whether the letter should only be focused on absences outside the UK or all absences from office (i.e. say for annual/sick leaves spent inside the UK). Absences outside UK only.. Also can you please advise if there are scenarios were we are outside the UK, but working for off...

Re: Setting up ltd company under Tier 2(G)

You as the main tier 2 general visa holder, if setting up a Ltd co, cannot claim dividends as then you have to do self assessment to pay tax, which will flag you up as self employed, which is not permitted. I have seen a similar suggestion here on the forum but I am not convinced that this is corre...

Re: Setting up ltd company under Tier 2(G)

there is no restriction on setting up a company on Tier 2. The restrictions are on working in addition to your main work.
I don't see any problem with your plan..but if you want to be absolutely certain and unless someone disagrees, you can have your dependant be the 100% shareholder.

Re: Help Needed.. Very Urgent.

not only that but your wife might loose the continuity part (not 100% sure) as she will get a new entry clearance visa and not a leave to remain resetting her 5 year counter needed for ILR!

Re: ILR through a 5-year Tier-2 visa (general) route

Essentially, you can not combine Tier 4 leave with another leave, except under the provisions of Long Residence. You can combine most Tier 1 & 2 leave and leave under some pre-PBS categories. Thank you very much. That clears it for me, it is not worth taking risk over this hoping that the caseworke...

Re: ILR through a 5-year Tier-2 visa (general) route

Generally, if there is a broad interpretation and a narrower interpretation of a rule, assume the narrower one and aim towards it, as the narrower interpretation would be a part of the broad interpretation and therefore you are protected either way. But worth noting that I am neither a lawyer nor a...

Re: ILR through a 5-year Tier-2 visa (general) route

Actually I am in a quite similar situation and I had almost concluded that the 5 years qualifying period would start from the date of Tier 2 visa granted and not from the start of employment. However, in my case, the wait is not as long as yours and I am, like you, keen to do the ILR as soon as I ca...

Re: challenging and tricky scenario TIER 2 related PLZ HELP!

Just to add (in case you are considering ILR) :
You will only be able to get a Tier 2 visa until September 2020. And you won't be able to apply for ILR based on Tier 2 until September 2020 or before (as your continuous period for ILR based on Tier 2 is broken).

CR001 was right at the time. However, those changes that she mentions have been reverted again and your wife can apply for ILR (no absence limit for dependants)..

Your dependant can continue with the existing visa . You just need to make sure that it is renewed (if it comes to that) before expiry!

Re: ILR appointment date - 28 days prior

Thank you for your response Zimba. It's just that I already had the payslip and the bank statement from Lloyds (which takes several days to arrive by post) and that is why I was keen on proceeding. But I will take your advice and apply in July instead.. The payslips sometimes arrive with a few days ...

ILR appointment date - 28 days prior

Hi there, I have a query regarding the date that I can choose to apply for ILR based on 5 years of Tier 2. My first Tier 2 visa was issued on 27th July 2012 and I have been with the same employer since then. I am trying to work out the earliest I can apply ensuring that the payslip that I have is st...

Re: Main applicant switches to ILR-what happens to PBS depen

no use, as she only changed to tier 2 dependent in 2017. Unless cost matters to the OP. The PBS dependant fee is less than FLR(M). For FLR(M), the OP will need to pay the visa fee twice + health surcharge again (~ 3,000) If it was possible to continue with PBS dependant, then the OP will now only n...

Re: Main applicant switches to ILR-what happens to PBS depen

Just to add, if your partner instead gets his ILR based on 5 years on Tier 2, then you can continue to extend your PBS dependant visa until you qualify for ILR (based on being his dependant on this visa for 5 years). The advantage in this case is that the counter for your would not be reset. If howe...
