Re: Return to Ireland with Non EU spouse

Given the fact that your spouse is Canadian (no visa required to Ireland) and you hold an Irish passport the application for Stamp 4 is actually very straightforward. Enter the state normally as in on holidays - through Dublin airport I assume - and within 90 days you and your Canadian spouse need ...

Re: Quick question regarding Non-EEA Spousal visa

She will be able to work legally right away, only problem is that she wont be able to prove that until she gets her resident card, which is about 6 weeks, if everything goes well. The eu treaty right gives her the right to legally work, but in a workplace they wont be familiar with this, many immigr...

Re: Residency card

This might be not that easy as u think. Ireland doesnt really like to accept parents or sister/brother unless they are REALLY dependent on you. For that you have to prove that they are solely dependent on you, before they arrived here, and after that. You have to show i guess at least a year worth o...

Re: Delays in issuing temporary stamp 4

Hi everyone, My husband and I arrived in Ireland from France about 6 weeks ago. I'm Irish and he's Ukrainian. He previously held a residency card for a family member of an Eu citizen for France. So, we applied for a residency card using form EU1 three weeks ago. So far we haven't received any ackno...

Re: German bringing non-EU spouse to Ireland

Hello all, I am German starting a working contract in Ireland starting in September. My spouse wants to join me and work in Ireland as well. She needs a Visa to enter, as she is from Peru. My question is, which Visa does she need to apply for to enter the country in a first place? Once arrived she ...

Re: Stamp 4 and Stsmp4eufam

Unfortunately that’s the current regulation for Irish citizens and their non EU spouses in Ireland. I have discussed this topic with friends in your same situation and definitely is something you can raise with the EU as a complaint, it will take time but you will get a response or at least some so...

Re: Stamp 4 and Stsmp4eufam

Everyone sees that as reverse discrimination, but this is not how the situation arose. Lets put it this way, in the beginning no one had automatic!! rights to just simply bring in non eu family members to a European country....than the EU started to fight for the freedom of movement right, and than ...

Re: Irish citizen return to Ireland after practicing treaty rights in other EEA state - confused about application

As i understand the rules, there is no way that a non-eu spouse can get like stamp 4, when they were not legally resident in Ireland before. You can travel with you German resident card for sure, and have to specifically ask them to stamp your passport, but im not sure they will do that now, that i...

Re: Irish citizen return to Ireland after practicing treaty rights in other EEA state - confused about application

That was what I was hoping for, that by entering with the residency card I would be able to get a 90 day stamp and be able to apply under national law. As this would reduce the length of time he would get citizenship to 3 years. Also, I wouldn't be scared of losing work during that time, as my husb...

Re: Irish citizen return to Ireland after practicing treaty rights in other EEA state - confused about application

I dont think she ever mentioned that they want to enter Ireland on the German resident card than switch to national law. First it is not possible (to be here more than 90 days legally, entering Ireland on the article 10 card is no problem) , the non-eu spouse has to be outside of Ireland to apply fo...

Re: Irish citizen return to Ireland after practicing treaty rights in other EEA state - confused about application

In theory 3 month should be enough to return and claim article 10. The ECJ made that clear, and that the reason behind you move is irrelevant. Unfortunately some county like UK doesn't want to accept that and forces people to live 6-12 months in another eu country before return, and they dont accept...

C is not a stamp its merely en entry visa category for 90 days not a resident permit What count is stamp 4 the day you get the letter confirming 6 months that is you first stamp (resident permit). For non-eu the requirement : "You must show that you have lived in the State legally for at least 1825...

Re: Stamp4EUFAM expire next year

Where did you read this guideline that we can apply for EU3 application 6 months before expiry of stamp4eufam only? If I apply exactly 6 months before expiry of stamp4eufam then that's exactly the right time to apply for Irish citizenship also, bcoz it will exactly be 5 years (6 months on temporary...

Re: Stamp4EUFAM expire next year

for the reckonable residency the period should start when u entered the country on the visa c, with eu spouse, not from the date when u were originally accepted for temporary card.
Cause u were accepted means that u were here legally from the day u entered the country

Re: EU3 plus/or Naturalisation after 5years of EU-Fam-4?

Hi Ana, At the end did you apply for EU3? I am in same boat and wondering whats the best route. Actually, seems after 5 years one can only apply for EU3, not EU1: http://www.citizensinformation.ie/en/moving_country/moving_to_ireland/rights_of_residence_in_ireland/residence_rights_of_family_members....

Re: Stamp4EUFAM expire next year

Thanks Broli :) I have seen your posts and found them helpful as you had a similar case as mine. Do you know if EU3 is usually given in the 6 months time frame? And can I apply for both the EU3 and citizenship at the same time? You can Apply for EU3 6 month before the expiry of your current stamp. ...
