You seem to have no knowledge of the Tier 1E route and have been advised poorly by your inept solicitor. If you got the funds from a third party, you can move the funds back to your own personal account. Then you also must get the third party legal declaration as explained in the guide as the money...

No, for me is an initial application and not an ext. but as they asked the same question from me and they were only based on what I had wrote on my business plan, I thought maybe at first they made a mistake and first considered him as initial applicant not extention.

You can either claim you have access to the money OR you can directly claim it as investment (DL, accounts, etc) It seems you are confused yourself and d not know what are you even trying to claim points for, personal access to money or already invested ! :?
