Yes, they will still probably wait for an update from INIS before issuing approval for citizenship, but that doesnt stop you from applying for the passport, as you now meet the conditions for it.

Both INIS and the court need to get this issue resolved ASAP. It is stupid and unfair to keep applicants waiting for ages due to one wrong decision from the court.
