No, I don't believe that's the case we are looking for. I guess we will just have to wait and see until tomorrow. If there really is another Irish Case (and Solvit and the Immigrationcouncil seem to indicate that firmly) then the postponement of the other case makes sense. The Judge wants to wait fo...

As far as I know today is only the hearing, and not a decission yet. The Judge has 4 cases to hear today (between 11 and 5), and this case seems to be the last on the list. That means we most likely won't get an update anytime soon. Even if the decission gets our way I wouldn't expect the DOJ to iss...

I don't want to dent anyones hopes, but remember that you need a formal job offer, and that the employer needs to support the Work Permit application. Unfortunately a lot of companies are not prepared at all to go through this. Very often as soon as companies hear the word work permit they are not i...

Another 4 days wait is not too bad. Does the High Court have some kind of Summer recess?

Next tuesday might just be the last date for me and my wife, as we intend to go househunting in the UK next friday.

Either they are running down O'Connell Street celebrating or they are sitting in a pub drowning their frustration... :?:

That's just a list of all the the EU directives that have to be implemented by the justice Department. They relate to different things, not only the EU1 procedure. As you can see the relevant one to our cases was implemented in April 2006, but unfortunately wrongly (in our opinion) implemented, as w...

It seems to depend on a case by case basis.

We hadn't received ANYTHING (not even a confirmation) for 9 months, until we then got the refusal letter.

The new procedure might have been implemented due to the amount of complaints and phone calls they got. But who knows...

The closer the court date comes the crazier the people get it seems.

And btw... yes, Ireland is a great place to live ... just not when you marry someone from outside the EU or if you have to deal with the DOJ.

Static and Flor_MZ... I don't want you to go celebrating straight away on friday after the court announcement. Your first duty will be to either call your better halfes to update this thread straight away or to get your asses into the next INET cafe and update the post. Afterwards you can go and get...

Yes, I think so. But knowing that this is Ireland the question is more if the Justice Department will appeal the decission and go to the supreme court, and if not, how long will it take them to implement the changes. I honestly don't believe that it will be a straight forward process afterwards. The...

We applied end of July 2006, and our application was turned down in April 2007 on the basis that we haven't lived together in another EU Member State before. We applealed the decission at the beginning of april and are still waiting for response to that. We got married in Dublin, so that doesn't mak...

According to the Department of Justice a weekend in the UK is not considered being a resident by the Irish justice Department. According to them they apply the UK Interpretation of Residency, which is: "By UK law you are regarded as resident in the UK if you are actually in N. Ireland/UK for 183 day...

:( yeah, that was our problem as well. My wifes visa had ran out a long time ago, and they refused to extend it or re-issue a new one here. That's one of the reasons that she left Ireland. We were stuck here and couldn't even go to see my family or to go on vacation. That's why we decided for her to...

Yes, it's in her home country.

But afaik you can apply in dublin as well, as long as you are legal here (i.e. still have a valid Visa).

Sorry to hear that Birdy. No, it doesn't say when you have to leave. We put in an appeal straight away (more then 6 weeks now) but haven't heard back on it at all. As long as the appeal is dealt with you are safe. This whole thing is a big mess. My wife flew back to her home country and applied for ...

EEA2 application - Income derived from abroad (Ireland)

Hello together, I am a German citizen and have been living in the Republic of Ireland for six years. Since 2006 I am married to a non-EU citizen who is residing with me in the Republic of Ireland. For personal reasons we are currently considering to relocate to Northern Ireland. I had a look through...

Lemon,

you have to be residing in Ireland for 5 years before you can apply for citizenship. The application will then take another approx. 2 - 3 years.

If you are married to an Irish Person you can apply after 3 years, afaik. But the processing time is still the same.

Cheers,

The "being resident in another country for a day or two" doesn't work. According to the EU Treaty Department the only evidence accepted is a residence Card from that country or Household Bills in combination with a lease agreement. Now you just have to figure out where they issue the residence card ...

There seems to be at least one recent change. New Residence permits are now issued for the full 5 years, and not for one year anymore. A friend of my wife got her residence card issued today for 5 years. She had applied via EU1 in November 2006, but had lived in her husbands home country before (eve...

I did. :-) We are completely moving up for about 6 months. My company offered me a UK transfer for up to a year or however long it takes to get the UK Residence card. After that we will move back to Ireland. By then the situation will hopefully be sorted, and it won't take an eternity anymore to get...
