Here the letter we received today: No, doesn't look like it to me. Dear Ms...., I am directed by the Minister of Justice, Equality and Law Reform to refer to your application for residence under the provisions of the European Communities (Free Movement of persons)(No.2) Regulations, 2006, which was ...

I am at work atm, but as far as I can see they refer in their letter to a Paragraph that is not in the official "European Communities (Feee Movement of Persons) (No.2) Regulations 2006" Documentation that they publish on their own website. So they must have added it at a later stage. And this added ...

Just to keep you updated. We just got a response from the Department of justice. My wifes EU1 application was rejected on the basis that we have not lived together in another EU country before living in Ireland. Wife read the letter to me, and I will put a copy up here later. According to the letter...

1. If you don't want to apply for s apouse visa, then she will just be here on a tourist visa 2. You don't have to register, and you won't get a GNIB Card. You only get the card after the EU1 application has been approved. 3. You can download the EU1 form from the justice.ie website afaik 4. No, you...

I personally sent last friday 3 registered letters to them. One to the EU Treaty Rights Section, another one to the Head of the Immigration Section last but not least one to the justice Minister himself (as he is praising himself on his website for making EU related immigration so much easier). I re...

BTW.. I don't believe the lawyer story from the Justice Department. I in fact know of one person (not on this board) who got the Stamp4 2 days ago, after she involved a lawyer (who is specialised on Immigration Issues). I have no reason to doubt her story. And this person has never lived before in t...

Thanks for the update. The whole situation sounds nasty, but exactly as I feared. The one thing that I cannot understand is why they don't get up their a**es and send people a letter explaining the current situation, with details on what the case is about, when it is due and what the effects of it m...

According to the Irish Implementation of the EU Treaty rights you can only start working after you got your residence permit. A PPS number does not make you eligable to work. AFAIK most people didn't even manage to get a PPS number before they got their residence card. My wife for example didn't man...

Hey Mikael,

congratulations. At what point did you involve the lawyer, and how many corresondences did it take to get the permit?

We are now waiting 8 months as well, and finally got a lawyer involved yesterday.

Cheers,

So the big questions are: - Where is this court case? - When is a judgement due? - How will the justice Department accommodate the people who are waiting for the last 6 - 9 Months (re-entry permits, work permits etc.)? It can't be that people are held prisoner in the country without any rights, just...

Doesn't this case refer to granting a residence permit to Family members of a Non-EU Person, based on that persons marriage to a EU citizen?

For example if I would apply for a residence permit for my wifes (non-EU) parents, based on my wifes marriage to an EU citizen?

I just called them.

You will need to find a job first, and then they will fasttrack your application while your EU1 application is pending.

As said they need Marriage Cert, Copy of Passport and the application.

We just called immigration. No good news. They told us now that the pending law suit still has not been decided on. According to them now the Ombudsman is involved in the situation, and we will def. get a decission by the end of April (latest), which would then be nine months. You really could...

I probably was just lucky. I have a powerdial feature at work, which might have helped.

But with time I figured out that the best chances to get through to them were between 11.45 and 12.30 or just after lunch at 2pm. That's when I usually managed to get through to them.

Welcome to the club. We are waiting since the end of July 2006. Almost 8 months now. Last week I got the direct number (the women at the switchboard who gave it to me must have felt sorry for me) of the person who deals with our application. I called him on Friday and he said that he is curren...

We got our passports back quite easily back in September. We sent them a fax requesting the return and they called the next day to confirm that we could pick them up any time. As I am the EU citizen I can travel, it's just that my wife can't go anywhere. Her Visa has run out, and they won't issue a ...

I have been living in Ireland for more then 6 years. My wife wasn't living here (or in any other EU country) before. Yeah, 8 months is an awful long time. My wife is pretty unhappy. She missed the wedding of her best friend, might miss the christening of my nephew (where she is supposed to be the go...

Hello Robby,

were you/or your wife (whoever applied for the Residence permit) lawfully resident in another EU memberstate before you/she came to Ireland?

Cheers,

Hello, today I got a response from SOLVIT, and there really seems to be a court case: I have contacted the Department of Justice, Equality and Law Reform in relation to your problem with the application for your spouse, Ms. XXX and her Irish residency application under Directive 2004/38/EC. I am in ...

Thanks for letting us know, robby. So hopefully they just told me a lie (probably only time to be happy to be lied to).

We are now just about 6 months and 3 weeks, and if they are in fact working on it in chronological order, then we should be due a letter any day now.
