so that would be a vaf4 correct Have a look at the VAF4, but just to give you a heads up, you'll actually do the application online through the UKVisas site. Once you've completed the online application, it will direct you to make an appointment for the biometrics, which will be done at a USCIS in ...

Why does she need a return ticket?
I never said she did. I said a single ticket was fine, just pointed out that return tickets can be cheaper

If you're entering on a spouse visa, a single ticket is totally ok. However, check the prices, return tickets are usually cheaper!

Sakura and Lady K, I couldn't have said it better myself! FWIW, jjohnmichael4u, the US immigration process is much more involved and takes quite a bit longer. A UK spouse is not going to have a US visa in hand within a week or two, the processing time is usually several months. Try searching through...

ILR holders are not subject to the "no recourse to public funds" rule. He can apply for whatever he is entitled to with no problems. Are you a UK citizen? If so, no problems whatsoever. If you are not a UK citizen/ILR holder, it's my understanding that he would not be able to claim MORE benefits bas...

I'm about 99.9% sure that you can't because it is a State law and not a Federal law. As far as I know, immigration is base on Federal laws This is correct. Even though same-sex marriage is legal in California now, it isn't recognized on a federal level. I had friends in a similar position, and they...

How long have you been married and how long have you resided in the UK since the marriage? It needs to be said that your safety comes first; everything else is secondary. If you are in an abusive situation, leave. Have you gone to the police yet? There are domestic violence hostels that will take pe...

Try searching through some of Archigabe's posts. He went through a solicitor and not only got the 5 year residence, but also his fees covered, IIRC. The DOJ wanted him to agree to a confidentiality clause as well, which he declined. In one of the older threads, there was also a link to an article on...

Yes. Assuming your wife is exercising a Treaty right in Ireland (employed / self-employed / student / self-sufficient), then EU law applies. You are entitled to permanent residency after 5 years of residence with her in the state. EU law applies because she is a British citizen. The fact that she i...

There is no way to get a spouse visa from outside of Ireland. So, what you would need to do is enter Ireland on a visa waiver and then go to the Garda National Immigration Bureau to apply for a Stamp 4 based on marriage to an Irish citizen. Try doing a search on the Ireland board on this forum; ther...

Well, nothing is guaranteed, but if the application is thorough, there shouldn't be any problems. If you're at all concerned, it might be worth your while to see an immigration adviser before leaving the UK and have them do a document check to make sure everything is in order. Might at least give yo...

Another main difference between the two is the length of time it takes to obtain permanent residence/citizenship. Scenario 1: spouse of British citizen comes to UK on two year spouse visa. Just prior to visa expiring, spouse can apply for Indefinite Leave to Remain. Once the spouse has lived in the ...

You're not considered a visa national in that you don't need to have to apply for a visa beforehand in order to enter the UK to visit.

Ok, you are living illegally in the UK, and are planning on entering Ireland illegally? As to whether you can marry if illegally in Ireland, I think it is up to chance. Some places will check your status, others won't. I have been told of immigration officers meeting the party at the registry office...
