FLR - post here if you FAIL

This thread is for anyone who has recently applied for FLR and failed, or if those who are about to apply and do not meet the required points. And, those senior members who can offer advice to them. I am in the 1+3+1 group and so far everyone who has applied for FLR has received it. I think this wil...

You are talking about specific facts for a particular case I am talking about classifications of groups. The court can not consider each and every person's situation in a class action. They are going to have to group together people in terms of how they are impacted in a meaningful and doable way. ...

London Blond I am talking about from a legal perpective of harm Feelings, betrayals are personal to everyone and one is no greater than the other. In terms of success on points, you have to be strategic. If there is going to be a ruling in our favour, it isn't going to satisfy everyone affected Sti...

Pretty much the delay will make the issue moot. The people most adversely affected were the initial HSMP applicants in 2002 when the programme was introduced. I don't agree. Those who were accepted into the programme only last year before the changes will feel no less betrayed if they fail to meet ...

Yes, because of the tribunal case earlier this year, with strong words toward the Home Office quoting human rights violations. I think the HO is taking this case very seriously. The momentum is in our favour. If things remain the way they are now, tubunal courts will fill up as thousands of HSMP hol...

I heard the date was postponed at the last minute. Something about Home Office not getting all the paperwork on time.

Well done laclassy,

My application is looming, so hearing your news is good.

Funny that they give you a further four years instead of just one.

This sounds like a good idea. I will also apply for ILR after completion of 4 years You will need a solicitor as each of you will be rejected when apply for ILR too soon. The tribunal case we all heard about was an appeal against deportation. If you appeal against an ILR decision, I don't think you...

"I do not believe you can be a highly skilled migrant if you have been in the UK for a year without a job. "

Byrne is basically saying to the public that anyone complaining about the new rules is unemployed and on benefits.

Rog

I might make the points and I might not.

Was lucky enough to start a ltd. company early last year well before the changes, so I'm sorted either way.

Well, unless HO drops another bomb soon that is.

Also, if I fail to qualify for extention after 2 yrs due to further rule changes in the future and in su...

Ha, I am the only one I think. My EC starts the date that I arrived in the UK. Was not easy to do, and was told that it was not important by the brit embassy. I heard that you can apply for ILR something like 4-6 weeks before the five year mark, but can't back that up as it was just in other posts. ...

I just don't get it. Byrn has announced a change, but hasn't yet defined what it means to existing hsmp holders. Shouldn't they wait until all is worked out before announcing?! Otherwise, they could be needlessly worrying everyone. Unfortunately, we can only guess right now how all will be effected....

I just get the feeling that some people have just not thought through the comments that they are actually making! Are people really saying that those previously granted HSMP are of such a low skill level that 90% no longer qualify? I for one think that HSMP people in the UK are highly intelligent, ...

Fortunately, ILR is nearly the same for HSMP as everyone else. You will not have to pass FLR(HSMP) points again, however you will want to have a job and enough funds to support yourself for the next x months. Also, there is a new Britishness test you will need to pass. Once you have an extension tha...

Only one of you needs an HSMP - do you know this? On yours, they will only want your income considered against points. I would definitely attach a brief letter explaining your husbands income.

Congratulations Ajani,

Funny that you have been given three more years. I heard they were doing this for those in our group. I think HO doesn't exactly know what to do with us just yet.

You're nearly there now -

balak2 - yes, you can get a part time job and add this to your total earnings. However this probably should be earned doing work in your field of expertise, otherwise you risk being rejected. If your job is really stable, and you have an easy time finding additional work to top up your earnings, the...

EC date (HSMP visa on your passport) is the date they go by for HSMP extensions.

For ILR however, they go by the date you first entered the country on HSMP visa.

For this reason, many people attempt to enter the country the same date as EC.
