5 years or 4 years 11 months for ILR?

I will be eligible for ILR on 15 June 2014 and my current HSMP / Tier 1 expires on the same day. I understand that I can apply for my ILR a month before, i.e. on 15 May 2014. However, I would be one month short of the qualifying period. I also arrived in the UK on 15 June (i.e. was not in the UK on ...

Thanks Jambo, yes I understand the extension would be from the approval date (not expiry date).

Any other experiences, especially from anyone who has been in that situation, would be welcome.

PEO Tier 1 Gen/HSMP Extension more than 28 days before expir

Has anyone applied in person at a PEO to extend their Tier 1 General / HSMP more than 28 days before their visa expired? Were there any questions or issues raised about applying earlier? I am considering applying for an extension more than 6 months before my current visa expires and want to know if ...

Yep you can just ask them to change your statement date e.g. to 14 Feb. They there will be one statement for part of a month, i.e. from the previous statement to the new statement date, and after that they will cover a full month as usual.

For absences, it has been suggested to me to take a spreadsheet showing departure date, arrival back in UK date, absence days, reason, and (if you can) passport page numbers showing stamps.

I don't put any marks on my bank statements (highlighting, comments, etc). I use coloured post-it flags that you stick onto the pages e.g. yellow to show salary transactions, blue for dividends, etc. The caseworker can see the relevant transactions right away, but you can remove the flags after you ...

The evidence you provide must match, so what is important is when you have paid your salary and dividends over the earnings period you claimed (no point saying your salary is monthly if your bank statements won't support that). What were the dates and amounts of payments made? Which were salary and ...

You could also put a note in your covering letter explaining that the payments were made by cheque and the info you have given in your posts. I think because the dates are close there shouldn't be an issue, but if the caseworker is having a bad day it wouldn't hurt to have the explanation in a cover...

You don't have to take all the profits from the company as salary / dividends. I don't take all mine, I pay a monthly salary and an annual dividend. The amount of the dividend varies each year depending on the company earnings and how much I want to pay out vs retain in the company account. You need...

Re: ILR query

I'm not familiar with his visas particularly. But I was under the believe to apply for ILR you had to be on a single visa type for 5 years (With exception of HSMP which is 4 yrs) So his time on the work visa wouldn't count. And is 1 year short for ILR. It depends on the visa type. Some can be aggre...

My most recent extension (under HSMP JR) was earlier this year, I think in March. The covering letter from UKBA also mentioned "Tier 1 (General)". I didn't get a BRP but I did have a vignette (a full-page visa) put in my passport. I confirmed with UKBA that BRPs aren't issued for HSMP JR applicants ...

As sushdmehta says, you can change jobs while your application is in progress. The forms and guidance on the UKBA website recognise the 3 year extension for those originally on HSMP. If you had a 90+ day absence, your ILR clock re-starts the day you arrived back in the UK and you count your 5 years again. Example: If you originally arrived in the UK on 1 Feb 2007 you would be eligible for ILR after 5 years = 1 Feb 2012 provided your absences are not too many and not too long. In...
