runie80, Your case is a lesson to the Irish government, athough they have no right to keep people stranded.Yet you can also make your own decision to run away from a society that is only interested in what they can get from you and not on your welfare. If expats are taking such a U turn decision,in t...

Good bye, Runie!!! I wish you the best of luck in England! You have really been helpful to me on this site, and I am sorry the conditions under which you are forced to leave. I must admit, I may be leaving by the end of the summer (if you can even call it that!). I am just shocked and appalled that...

I am not sure why so many people see the Jia case as important in the context of our situation. As far as I understand the Jia Case was about the residence permit for a non-eu parent of a non-eu spouse (who was legally resident in Sweden due to being married to a german citizen). I am not a legal e...

Sorry to be away for a while. Its sad that the long waited Kumar case went negative.Although i never expected anything from the case, especially when the bases of the case were not known. In any case the Jia case is still the clear route as far as the Irish article3(2) is concerned. I sincerely encoura...

No ranting today, but the Irish should what is right.Remember in all her refusal decision, there in no mention of removal or to leave the country. If they do,Article 8 will challenge such action.

The issue in the directive in question has no relevance to spouse/family member of an EU national. Its centred on the rights of third country national legally residing within the EC member states and their family unification. The thing is that not everyone has the will or even the money to go through the courts to fight for his rights. So we have to rely on these court cases. And in the context of the EU regulation it shouldn't really matter what the history was. It seems Kumars case was the one everyone was waiting for...

BigAppleWoodenShoe : I know this topic relates to non-EU marriages to EU citizens and their residence problems in Ireand. Joe80 asked a question though, and he is in a different situation to you all. As for proving your relationship before you get here. Yes, but I'm guessing that now that as a Spousal Visa application for non-EU spouses of EU (not Irish) citizens, is now quite similar to a Tourist Visa, i.e. it does not afford residence rights (only the initial 3 months), nor does it allow the ...
