Considering the reasons given and the evidence provided, this refusal should be easily overturned at an appeal. None of the reasons they have given are legally binding. But, why did you mention that you were coming over for studies? Just working alone would have been enough.

How do you intend to get married if you are an overstayer? Once you do get married, you can try and make an in-country application with the EEA2 from UK. Expect long delays and persistence will be needed in huge quantities to make it through.

You cannot switch in-country to the UK route. You will have to leave and then apply and then spend 2 years on it, effectively taking the time of your ILR to 2009. So, there is no point in doing it.

The best thing to do here would be to use the 'ppron method' once your husband becomes a BC.
