Here is the interpretation needed for you to apply for the Proposed Civil Partner visa under the UK immigration rules wich is based on the rule that you had highlighted earlier. The problem is that, it is only during this stage that you will considered to be present and settled and for subsequent a...

mischa, I kind of agree with you and admire your determination to see it through as well. There is the option for you to apply under the UK rules as well. But it is only for the Fiance/Proposed civil Partner visa. Just give me time to dig up that information.

To add to John's post, the Surinder Singh route can only be used if the British Citizen is planning on returning back to the UK for settlement purposes. If coming back only for a visit, the spouse will have to apply for the visit visa under the UK immigration rules.

There are people on these boards who want to see people punished, but I believe the application of justice should be proportionate to the infraction I think that the vast majority of the people even the ones not acquainted with a board like this will agree with that. Very few people would want over...

Can people become illegal immigrants without breaking the law? You can believe the answer to be either Yes or No or don't know. But anyone saying they believe it and don't believe it ends up looking silly. People could also become illegal accidentally and not all cases would present itself with rib...

Your position can be either that people can become "illegal immigrants" without breaking the law or that they can't. Hmmm..."You are either with us or against us." You can't sit on the fence. Actually, I can! I do not want the luxury of seeing everything as being either black or...

The Residence Card for non-EEA family member is valid for all Schengen countries, even though they can insist that your EEA family member be travelling with you.

jes2jes, Victoria has already reported that she had already tried that line of defence at the HO and had not succeeded. So, an email might not yeild any different an opinion from them. The HO may not respond to logic and it is not logic alone I am talking about. It is the interpretation of the law a...

Wanderer, I also happen to believe in redemption. Eternal rejections of applications for overstaying doesnot happen to have a proportionality that fits the crime IMHO. It is like giving someone 5 or 10 years for smoking a joint or jaywalking or driving above speed limit etc, all of which are also &q...

MartinKing, it is nice to know that your steps now seem clear to you after the HO confirmed what you have been told. There is no harm in getting a second opinion. Regarding the faxing of the HO about continuity of residence, I see no point in coming online and asking us about it, as a quick fax shou...

Also, it's 180 days, not six months. Pedantic, yes, but it could mean a big difference to someone who plans leaving in the last few days.
OL7MAX, I just had chance to look at such a visa and and I must say, it was issued for 6 months and not 180 days... Do I hear a sigh of relief?

You are making the mistake of applying logic to the Home Office, and you are suggesting that they only apply the law lawfully...we know this is not true!!!. Yes! But even they are not above the law! If they do not follow it and gives no right to appeal, there should and must be a legal way to chall...
