What is your nationality? What is your ex's nationality? Does she have British citizenship, ILR, or Permanent Residence in the UK? What about your son? Were/are you and your ex married? The new requirements (for applications submitted on or after 9 July) for access to a child require that the child ...

You do not need to prove you had a family permit in order to apply for a Residence Card. You only need to show that you are married to an EEA national who is exercising treaty rights in the UK. Unless you are umarried partners (as opposed to spouses) then the only disadvantage you are at is that you...

Is that 1200 before or after he has paid tax? Do the "few things going in and out" of his bank account include any loan repayments? If his total monthly rent and CT spend is only 540, then he should have enough left to meet the old maintenance requirements if his net pay is 1200. Can you post the fu...

She can apply on FLR(M) as an unmarried partner and rely on EX1 if it would not be reasonable to expect her British citizen child to leave the UK. That would put her on a 10-year route to ILR if successful. She could also apply under Zambrano if her British citizen child is dependant on her to exerc...

You can also include a covering letter that explains how the requirements are ...

The money your partner needs to show is set out in paragraphs 13(b) and 15 of Appendix FM-SE of the Immigration Rules. This means she needs to show that: Her annual salary when you apply is at least #18,600 (i.e. the salary for the job she has just started, calculated based on her most recent paysli...

There is no bar on your getting married: check your local register office for requirements on giving notice and making an appointment.

If you intend to live together in the UK after you are married, you need to consider whether you meet the requirements under Appendix FM of the Immigraition Rules.

It seems like an interesting and relevant case - it would be great to find out the result of the hearings. I am not sure if I can rely on the fact that I have retained the rights of residence, because the UKBA issued quite confusing statements. The case is Alarape . It would be more straightforward...

I would be very grateful if you Kitty, or perhaps someone else, could clarify for me the following points: 1) Is there a particular requirement for an employed or self-employed person to earn a certain amount of money to be deemed as a “qualified person”? For instance, if my father is employed, but...

There are a couple of problems here: 1. The EEA4 form does not clearly cover the requirements for a former step-child with a retained right of residence, and 2. The UKBA has issued confusing statements about kroketa's retained right of residence, so we don't know whether they are in full possession ...

It is difficult to see how you may qualify for a ROR if you are unable to provide evidence for the year preceeding the divorce, that your wife was a qualified person. The Regulations only provide that the applicant was living in the UK "in accordance with the Regulations" at the date of the divorce...

Hmm. Now I'm confused for another reason. Reading paragraph 19(c), it seems to suggest that the *only* income that can be counted is income drawn from the post-tax profits of the company (e.g. dividends). I award myself both salary and dividends, as I'm sure do 99% of private limited company owners...

Ah, I see. Yes, the routes I outlined depend on your wife's being able to move to Ireland with you. Do you have any visa routes to Ireland in your own right? (Perhaps that's the "red tape" you were referring to earlier)... If that's the case then it might be a temporary fix during her last year of u...

Check the UKBA website as the spouse visa rules changed significantly on 9 July this year. It's now a 5-year route to settlement under the Immigration Rules, and there are income requirements in place (ordinarily the UK partner needs to earn #18,600 per year) and no permission for third party suppor...

Relocation to Ireland might be a possibility (although I suspect great amounts of red tape going that route)... Not sure why you think there would be excessive red tape, but your wife has a right under EU law to live and work in Ireland and you as her spouse a right to accompany her. In addition, o...

Re: spousal settlement: self-employed proof of income

The following is my interpretation, arrived at rather painfully and using at least 3 windows open at all times on the desktop to compare and contrast the various bits of Appendix FM and Appendix FM-SE of the Immigration Rules. frustratedbrit , it looks like you have been referring to the guidance in...
