Everything remains same until they are able to figure out brexit.
Just to clarify the new BRP my partner has acquired will work in the same way the old Residence Permit on the passport?

Re: Experiences using new UKVCAS for naturalisation/citizenship applications

Hi, Thanks for your full details on this. Just to confirm, where you able to keep hold of your passport so that you can travel whilst your application is under consideration? I noticed on the gov website it says: We will seek to return documents to customers at the end of the appointment, with some...

Non-EU travel with BPR and Partner

Hi, My partner recently received her BRP which stats Residence card of a family member of a union citizen. At the back it has EU right to Reside. The previous residence permit was on her passport and said Family Member of a EEA Citizen. I am a EU citizen and we always travel together, never had any ...

Re: Experiences using new UKVCAS for naturalisation/citizenship applications

I went to my appointment with UKVCAS at the Cambridge service point. It is tucked away on the top floor with most of the privacy being provided by banners. After finding the entrance to this little alcove, there was no wait and I was immediately seen to: I was asked for my passport and appointment ...

Re: Experiences using new UKVCAS for naturalisation/citizenship applications

Hi, My partner (non-EEA) just got BPR card and as I am dual EU/British can apply for British citizenship straight away. When I applied for my British Citizenship I took my documents to be checked (by a council service I believe) before the application was sent so that I could hold on to my passport....

Re: Do dual EU-UK citizens have rights under EU law?

Thanks @silverman123

Got my dates confused. I thought the information for EU Regulations 2016 was coming up under the latest updates.

Anyway, I am sure everything will be fine as the law is on our side :)

Re: Do dual EU-UK citizens have rights under EU law?

Actually just reading the Immigration (European Economic Area) Regulations 2016 and it says: Family members of British citizens 9.—(1) If the conditions in paragraph (2) are satisfied, these Regulations apply to a person who is the family member (“F”) of a British citizen (“BC”) as though the BC wer...

Re: Can I apply for EEA Family Permit while in UK as tourist ?

I don't know if you can apply for a EEA family permit from within the UK as we did not do that, only after we got the 6 month one. Perhaps someone else can confirm this if they have been in the same situation. Regarding to flying together without a visa I don't know if anyone would allow him on the ...

Re: Can I apply for EEA Family Permit while in UK as tourist ?

I don't think you can apply for for the EEA FP as the non-EEA person would have had to be in the UK for 5 years. My case, EU citizen living in the UK. Met my non-EU partner abroad and then decided to get married, we applied for a Fiance visa to get married in the UK which was refused so we got marri...

Re: Do dual EU-UK citizens have rights under EU law?

Unfortunately nothing is certain at the moment but this is an interesting read: https://europeanlawblog.eu/2018/03/05/lounes-naturalisation-and-brexit/ A few people here are in the middle of applying for PR EEA. Me and my partner will be in the same boat in December. I just got my BC, my partner is ...

Re: Do dual EU-UK citizens have rights under EU law?

My extended family member application has also been refused because I am a dual national, which is what I was expecting. I cannot appeal yet because the refusal is under 2016 regulations which don't allow appeal against refusal of EEA FP to Extended Family Member. Waiting for the opinion of ECJ on ...

The intro kinda sums it up: "Lounes has now added an interesting twist to this situation. The essence of this judgment is that a migrant Union Citizen who naturalizes cannot be compared to a native citizen – their migrant history means that they should be treated differently, and continue to enjoy t...

Re: Do dual EU-UK citizens have rights under EU law?

I agree with success82. It is important for people to share their experiences and use it when applying for whatever we need. Yes it is scary to think HO may refuse the application but remember the law is in our side for now but there's not much we can do but learn of other's experience and do what w...

Re: I have Dual Citizenship -Wife non EU . 5 years Visa finishes ...

Just found a few things online: http://www.bbc.co.uk/news/uk-politics-41012265 UK will leave EU court's jurisdiction but this won't be until at least end of March 2019. This will depend on the transitional period which could take years as per this article: http://www.telegraph.co.uk/news/2017/08/20/...

Re: Do dual EU-UK citizens have rights under EU law?

keep in mind though that yo are not officially British until you attend the ceremony. Maybe there is a way to postpone this or in the worst case, then there my be an option where you need to re-apply for the BC again if you miss it. I rather pay 1200£ to re-apply (and this should be pretty straight...
