Re: I need my kids.

Hi, Are you suggesting that, if she just goes back to VN, supposedly abandoning her children with you, that the HO will have no other option but to grant them ILR, and you their custody? This is a plan that might just backfire badly, if you are not their legal guardian, then the govt may just take ...

Re: Visa for Ukrainian wife

In your covering letter, stating where you will stay, and a letter from her confirming where you will stay will not hurt at all. However, her saying she will make sure you return and be responsible for your actions while you are here has no weight, since the HO want strong evidence you will be ...

Re: Spouse Visa Appeal

Personally, I think that the word "insurmountable" means that, they will not consider those things you have mentioned, since they are not insurmountable, just a hard problem to deal with. However, if you have now met the financial criteria they refused you on, by providing the right pay slips, then ...

Yes, that is my opinion from personal experience. Your and your mother's word mean nothing to the HO.

Re: Visa for Ukrainian wife

She will need to prove she has strong ties to return. Your mother sponsoring her will make no difference and I am not sure, but your sponsorship might just be a negative, since the HO may well consider that you are trying to get her to the UK but you do not meet the criteria for a spouse visa. Her ...

Re: received sms that processed visa application was received what to do next

So to be clear, you went to the visa centre, but you had not received a text expressly telling you that your visa was there for collection, and instructing you to go? If so, just another example of the HO providing no clear information or guidance.

Re: Spouse Visa Appeal

Did your refusal letter from the HO give you a right to appeal? If it did you have nothing to loose, but some time (seems to be around 10 to 12 weeks average) and the appeal fee. Oh and I would suggest using a lawyer, probably another £800. If your appeal is turned down, then nothing stopping you ...

That is the same email we received, it means (it did for us anyway and they do not want your passport for any other reason) they want to issue you with your visa/ travel vignette depending on what you applied for. We did not receive a reply email confirming anything. Just a text from VFS to come ...

Re: Can I still apply a visa if my student visa runs out in 3 days?

And I would expect that you would have also had to of already been provisionally accepted onto a recognised course (as opposed to one of the fake ones we have been hearing about) to be able to apply for a student visa.

How will you support yourself, is probably a question that will need answering?

Re: Extending stay period for my Mom's visitor visa

If you have a valid visa, I am fairly certain that as long as you leave before it expires, no one will take a blind bit of notice. How could future applications be affected because you obeyed the visa? People's travel plans can change and wanting to stay longer to be with a grandchild is a perfectly ...

Re: Visitor visa for mum with no income. Help please!

You've already made the best case you can, with what you told us. She has a husband and children to go back for. Get all of the birth certificates, marriage certificate and then add the deeds to all the properties they own, and rental agreements to show they are making an income. I think you have a ...

Zerubbabel, I know very well what you talk about. There are many on here who should not remain in the UK, but desperately try to. I also worked with a girl some year ago now, who met a lovely man from Jamaica while she was on holiday. Everyone told her she was stupid to marry him, but she did. He ...

Re: Fiance visa - actual cost

Also, in 2.5 years you got to pay for the visa again. I am not sure about IHS again though. It also really peed me off too, I am as British as anyone can be, and just because I chose to marry a girl from Vietnam, I've had to spend £K's on visa's too. I, as a British man, should have the right to ...

Re: Spouse Visa Curtailment after 2 weeks abroad?

Presumably she will need to go through the spouse visa renewal process again in less than 6 months, at which point the HO will not issue her visa and she will be made to leave? Or does she intend to overstay and not even apply for the extension?

Brian, I am no expert, but I would say you have grounds to appeal that decision, you can't help the fact that your employer did not pay the NI or tax for you, that is between them and the IR to fight over. I would speak to a lawyer, mine was excellent, so if you want to PM me I will let you have his ...

Re: Travelling restrictions UK spouse visa:How long can I stay outside of UK with UK spouse visa.

Seagul, the OP asked how long she could stay outside the UK without affecting her spouse visa, you said "no absence limit", which is probably incorrect. So somewhere between what you said and zero days is the answer. You have provided no backup for your statement, the only detail I can find that you ...

Re: Travelling restrictions UK spouse visa:How long can I stay outside of UK with UK spouse visa.

See this paragraph. "The earliest you can apply to settle in the UK (called ‘indefinite leave to remain’) is after you’ve lived in the country for 5 years continuously with permission to stay (‘leave to remain’) as a partner. You cannot count any permission to stay in the UK as a fiancé, fiancée or p ...

Re: Travelling restrictions UK spouse visa:How long can I stay outside of UK with UK spouse visa.

I am not sure that there is no limit Seagul. Don't the HO require evidence that the applicants were living together, when the extension for the further 2.5 years is applied for? What you imply is that the two people can live separate lives in different countries from day one of her visa being ...
