Re: Pre Action Protocol for UK Visa

It would be helpful to those who are considering a PAP, for you to share your refusal letter from the HO. What reasons did they give for refusing your visa and why do you say they are wrong?

Re: Marriage Visitor Visa Guidance

Hi, My wife and I got married in UK, with her on an MVV, so you can do it. It is fine. She will need to leave the country before 6 months ends, and then you apply for a spouse visa for her to come back and live with you in the UK. You must prove she will return to her home country, and that the rela...

Visa for second wife

No, because in the UK you can only have one wife.

Re: Marriage Visitor Visa Documents?

The HO are concerned that your Fiancé will not return to her home country after 6 months. She must prove that she will return and you both must prove that the relationship is genuine. The HO decided that despite pictures of my fiancé and I all over the World, her impeccable travel history, her profe...

Re: Marriage Visitor Visa Documents?

Ali, I am sorry to say, but I do not think you will be granted one for you GF. I can say this from personal experience of how hard it was for me, and I was employed, earning good money, had met her loads, own home etc etc. The HO will almost certainly consider her a flight risk and deny your applica...

Re: Spouse visa appeal (article 8 human rights)

The issue is not the applicant's honesty, it is whether the he/she meets the requirements to qualify for a visa. If every applicant was able to argue extenuating circumstances, and be granted a visa outside, then that would make the guidelines irrelevant. And if only some people can overturn the cor...

Re: Spouse visa appeal (article 8 human rights)

Borders, you are still arguing the same case, you have added no substantial reason why you should be given a visa. You are still in the same situation, and seem to be clutching at straws hoping that if you keep appealing, you will find a judge who will decide in your favour. How can you convince a j...

Re: Applying for a parent visa while in the process of negotiating divorce

I can only advise you to leave him but don't pay any of his expenses, open a new bank account and have your money go into that. He has asked you to leave the family home, so find a new place, and then leave and take your child with you. He would need to take it to court to get access to him/her and ...

Re: Applying for a parent visa while in the process of negotiating divorce

Renny, I do appreciate it is always easier to give advice, but not always as easy to take. But in this case, please do not let yourself be the doormat. Protect yourself and kids. Does this man bully you mentally or physically? Have you thought about returning to Taiwan with the kids? Why stay here, ...

Re: Applying for a parent visa while in the process of negotiating divorce

He can't do that in the UK, he has no right to demand 95% of your salary or stop you from seeing your daughter. You are the mother and have more rights than him, especially if your child is young. How would he expect you to survive on 5% of what can't be a huge amount if you earn part time? Do you r...

Re: UK Standard Visitor visa refused for my dad

Your father has been turned down twice now and I would say he is unlikely to get a visa if you re-apply now, so applying again is a waste of money IMHO. My thoughts would be go for a PAP, do it yourself. Email them and insist they explain what information exactly do you have to provide for them to g...

I would have thought the police would be a good starting point. They will either do something or inform the correct authority for you.

Hi All, I am British, my wife is from Vietnam and is living with me in the UK on the first 2.5 years of a Spouse visa. We are thinking of going to Europe and arriving back in UK before Dec 31st this year. Currently, obviously I do not need any kind of visa, but does my wife if she is travelling with...

Re: EU family member deported from the airport

Once again Zerubable is the voice of reason. I don't think the OP is telling us everything, border control know their rights and responsibilities well, and would only have sent the OP back without thoroughly checking his story out, and being sure that their decision was the right one.

Re: Spouse visa

I think the rules say you must be able to show one year's trading at least, but someone else maybe able to tell you if you can have interim unaudited accounts done to add to your 6 months pay slips to demonstrate the required annual income of £18.6K assuming no kids involved. You need to show bank a...

Re: Spouse visa

you will need unaudited accounts. These will need to be done by an approved accountant and will cost about £470 or so to prepare, but you can then put them down as a tax deductible expense.

You can of course only get those done when you have completed a year of trading.

Re: Spouse visa appeal (article 8 human rights)

15 weeks was the amount of time usually given for cases that are not being sent to court to be heard by a judge, since there is a team set up by the HO to review cases quickly and try to stop them being escalated to court and thus free up judges time. But for cases where a judge is involved, it is f...

Re: Spouse visa appeal (article 8 human rights)

What chance did your lawyer give you of winning this case? Did he tell you that you had very good grounds for winning? Was he OISC approved, or did you find him in India and all he is doing is representing you so he can get paid, but really he knows you have little chance of success? Didn't your law...

Re: Spouse visa appeal (article 8 human rights)

Your hearing could take 6 months, could take a year. Covid will probably have added many weeks to the length of time before your case is heard. I am pretty sure as has been said before that your uncle saying he will sponsor you will not help, since he can go back on his word when you arrive, and jus...

Re: Spouse visa appeal (article 8 human rights)

Muhammad, Your issue is, you are not eligible for a visa, didn't you check what would be needed before you got married, or did you think you could find a way around them? You do not have any savings, your wife does not earn enough, and in-fact relies heavily on the state, and there is no clear evide...

Please proceed with absolute precaution and please don't let your soon to be Ex wife take you for a ride again. There is a really nice lady with good intentions out there for you, and she will come along, so don't look back. Onwards and upwards.

UK Wife of US Citizen Visa

Hi All, This is a question for my niece (British) intends on marrying (in the UK on an MVV) her US fiancé. Once married she wants to move to the US to be with him and live there. As I understand it, it is far easier for her to get a visa to join him, than if she was to apply for a Spouse visa for hi...

Re: General circumstances in my relationship for Fiancé visa application

If you go to her country and marry there, and then in a couple of years later move back to the UK, I think the process will be much easier to get her visa. Again, I stand to be corrected, but living together for two years almost means they can't refuse? I guess whether you take that route depends on...
