but honestly, even FLR is quite well defined how and who to be eligible to apply, therefore both are risky.

i am not sure the right of appeal for FLR,

however, ILR 10 years route to me you may really have no right to appeal because your case is just too obvious, you don't have 10 years before sept 2019. Just hard fact, nothing to agrue.

you said your employer didn't do market test so rejected the first one, and didn't apply the second one within 28 days of the refusal of the first tier 2. I think depends on the severity of the crime. if it is a serious one (can be lead to imprisonment), they usually won't decide until the judgement is final.

Evidence that

1) showing you and your wife have lived together for at least 2 years.

2) Financially your family would not rely on benefit if your wife granted ILR.

yes you will likely be refused because you are illegal until jan 2012. So your application will consider only 10 years after you have legal right to remain in the UK, which should be jan 2022.
