Re: Court rules "continuous residence" means you CANNOT LEAVE IRELAND AT ALL for year before application

Sorry in advance if this creates a topic within a topic, but it is still related to the ruling: There were three arguments presented at today's Court of Appeal hearing. To paraphrase: Jones (appellant): Spent 100 days out of Ireland in the year before he applied, thinks this is reasonable, and that ...

Re: Court rules "continuous residence" means you CANNOT LEAVE IRELAND AT ALL for year before application

What does this all mean. That they couldn’t come up with a decision? I don’t understand this https://en.wikipedia.org/wiki/Reserved_decision Reserved decision is a legal term. After the hearing of a trial or the argument of a motion a judge might not immediately deliver a decision, but instead take...

Re: Court rules "continuous residence" means you CANNOT LEAVE IRELAND AT ALL for year before application

Hi Markem, I just check the page again and at the bottom, it is stated that below. Friday the 15th October 2021 In Court 2, Court of Appeal Building At 10.30 o'clock For hearing 2019 344 Jones -v- Minister for Justice and Equality (1.5h) Who knows what that is - I never looked down the page after I...

Looks to be going ahead... it is on the list here.

It will be heard by Justice Birmingham, Justice Whelan, and Justice McGovern - all are existing Judges of the Court of Appeal.

Re: Court rules "continuous residence" means you CANNOT LEAVE IRELAND AT ALL for year before application

This could still throw a spanner in the works. The Chief Justice has warned cases could be put back to 2021 if there is not an “immediate” increase in the number of judges on the Court of Appeal bench. ... If judges are not appointed by next Tuesday, Judge Clarke said it is his “understanding” that...

No there is item in 3rd October
Which item? I can't see one. The Minister has already said they're waiting for the Court of Appeal to hear the Jones case at 10.30am on 8th Oct so I'd be surprised if it comes up in the Dail before then.

Re: Court rules "continuous residence" means you CANNOT LEAVE IRELAND AT ALL for year before application

The key piece is that the Minister has confirmed they are waiting for the outcome of the appeal before introducing the new legisla...

It sounds like the matter is going to be discussed this week. if they pass bill this week hopefully we will get ceremony by end of Oct or first week of Nov. I'm not sure where you get the idea that it is going to be passed this week. It's not. There are 27 Bills currently on the Dáil and Seanad Ord...

Re: Irish Citizenship application (Form 8) - How did you organise your application?

In the past, they have managed to close around 60,000 applications awaiting a decision, from what I have heard. They can close these 16,000 apps easily, but, only if they want to. When did they do that? If you look at the chart (based on data from INIS), the most decisions they've made in a year (i...

Only a complete calendar day (i.e. 12am-12am following) should be counted. In your example, you were in Ireland on Friday and Sunday, so only Saturday is counted.

Re: Court rules "continuous residence" means you CANNOT LEAVE IRELAND AT ALL for year before application

The Minister has responded to a series of questions in the Oireachtas about this topic.
As of 3rd September there were 15,647 applications for citizenship on hand. The majority of such applicants are potentially affected by the ruling.
