Re: Form AN Question 2.1 - place of first arrival in the UK

You haven't even submitted your application yet and are already banging on about "how badly trained" caseworkers seem to be (which they are not). As for form AN, yes the beauty of a decade ago was that it was a mere 4 pages but it has become ever longer precisely because people needed more and more...

Re: NCS Appointment a week before 1 year due?

Yeah it's strange cos she went through my form with me (online request) looking at when I got ILR, etc and if I met the requirements. I specifically mentioned it to her that one cannot apply before 1 year has been completed on ILR, to which she said 'we have a leeway of up to a week'... Yes, I thin...

Re: EEA(PR) submitted well over 6 months ago- NO DECISION

No excuse. They are the government, they should follow EU laws until Brexit, not make things up as they go along. If the government can bend and break the law to suit themselves, then surely we can all break and bend the law to suit ourselves. I agree: law is a two way street. But they never have p...

Re: EEA Permit

Basically, I overstayed my visa while I was in UK, but unintentionally. I left the country and no one knows when. Cuz when I was at the airport, no one checked my passport. The UKBA has access to the airline records, so this may or may not have been detected at the time. That being said, under the ...

Re: Supreme Court: Home office to prove marriage of convenie

That summary makes no sense. The EEA Regulations 2006 Regulation 21B(2), which 19(3)(c) depends on, says, The Secretary of State may take an EEA decision on the grounds of abuse of rights where there are reasonable grounds to suspect the abuse of a right to reside and it is proportionate to do so. ...

Re: British Overseas Territories & Illegitimate Children/Adu

I can feel your concern about being treated differently, but I am not quite sure I get your argument. The whole point of British Citizen by Decent is that your children are not British, unless they are born in the UK or demonstrate ties to the UK. So comparing your situation to one who's father was ...

Re: British citizenship refusal/Applied for reconsideration

PS: Check the entry "Type of document". If it says "Document certifying permanent residence", you are correct, and they are wrong. This would not be the first time the home office is confused by their own rules.

Re: British citizenship refusal/Applied for reconsideration

It should have an expiration data. A registration certificate usually has 5 years, while a permanent residence card (and it is not always called correctly) is valid for 10 years. Check the sticker, it is the important bit, not the blue paper.

Re: British Passport refused for an adopted child of EEA cit

That is absolutely shocking. How could somebody work in the passport office for 18 years and still not grasp the basic concepts for the EEA regulations? It seems to me that they are pretty much wrong in every point. I hope you have a reasonable record of the phone call, but I would also ask for a wr...

Re: EEA Spouse visa

1. If I go home I can get the EEA permit within 30 days (100% received EEA permit by this date) 2. If I stay in the UK it appears most people are receiving their CoA in around 4-12 weeks. I would certainly stay in the UK. Leaving involves the risk that they refuse your visa for spurious reasons, an...

Re: British Passport refused for an adopted child of EEA cit

On the other hand- if the Passport Office grant a British passport to a non-citizen, the passport is invalid and may be withdrawn, or renewal denied, at any time. That may be true, but it is not applicable here. There nothing to suggest that the person is a non-citizen. The only issue is the suspic...

On 2005, all students were allowed to work 20 hours during term time, which I did. I renewed my visa 4 times and received my ILR too, never any issues. Not sure why Now HO wants to see a evidence of receiving authorisation. Anyone faced this kind of problem ? Not sure what to reply back to HO. This...

These are all separate applications, AN1 for you, and I think EEA3 (EEA PR?) for the kids. It is actually 85 pounds, because of biometrics, but probably still worth it.

Re: Not renewing British passport any advice????

I would never advise to use deception in these matters (although I accept that it is sometimes necessary).

The only clean solution is to give up British Citizenship, which is a rather radical step. Would you consider that?

The home office bureaucracy is pretty disorganised in my experience.

I would recommend to write a letter to your MP - they can enquire with the home office.

Re: British Citizenship Enquiry

They do not have to give up German citizenship - a second European citizenship is accepted. Of course both nationalisation and registration are pretty expensive, but it may be worthwhile. Theresa May's current plains for ILR for EU citizens may be even more expensive (the usual fee for ILR is over 2...

Re: British Citizenship Enquiry

In theory, their status is protected in any case, although with the current trends in the home office I would not rely on that. However, since they have all lived in the UK for 5 years, they have acquired PR by now, and therefore have their own status. It may be worth applying for PR for the whole f...

Re: EEA spouse NOT working applying for British citizenship

Usually you would use bank statements to "prove" residency, but the NCS advised against using bank statements. They said either tax or benefit records, GP registration, or doctors attendances would be recommended. So we went with the later. We will see how that works. If in doubt, I would also submi...

Re: EEA spouse NOT working applying for British citizenship

I agree that training for European rights is very poor, and my suspicion is that this is by design rather than by mistake. If you study the casework guidelines, you also find many cases where the guidelines are wrong, and then there also a number of instances of procedures being clearly illegal etc....

Re: Absence over 450 days in 5 years

Check the booklet AN Requirements - it has quite a detailed list on how and when discretion is exercises with respect to the absences. The 600 days seem to be not a big deal if they are mostly work related, which should be obvious from your list of absences. The 120 days in the last year are possibl...

Even a British passport is only prima facie proof of British citizenship and the person can be asked to prove again that they are British citizens. Yes, of course a passport can be is...

No. I looked into the alternatives, and they are at least as expensive, and usually more arduous. To be honest, the whole language test is more of a biometric exercise anyway. They take your picture, they take a voice print, and they check your passport at every single step. It is not really about y...

Although she has offered nothing new but her conditional offer is a good thing imho. She wants the same reciprocal rights for the British citizens living in EU - which surely is good thing. No? No, it is not a good thing. The EU offer is to keep the existing EU legislation in place - to treat Briti...

Re: Need guidance as to how my family shoud proceed

Ok, let's separate the two problems. For your sister, registration using MN1 is an option, because her child was born in the UK (I assume), and your sister has acquired permanent residence status through 5 year legal residence in the UK. For you, the situation is different, because you are not born ...
