Re: TB test exemption or not?

You are not classed as a returning resident so will need TB cert again for Entry Clearance. TB results are usually given within a week and if it is sent to laboratory it can take up to 8 weeks in Lahore IOM, so check with them to see how much longer. Yes, I thought so cause I consulted few solicito...

TB test exemption or not?

I lived in UK from October 2014 till 29 September 2018, moved back to apply entry clearance spouse visa. I went for TB test but was referred to sputum test since I have mild scars on my lungs from the TB I had in 2005. I just saw on UKBA website that TB test is exempted if, ‘youre A returning uk res...

Re: Online Application Form help please

It is 'settlement'; 'settlement', 'husband', you are the applicant, not your wife. Thanks for the help. Another question in the form is sponsor details, I have filled up my wife's details, is it corrent? I have filled her details in spouse section as well. In VAF4A form, whose statement would be at...

Re: Spouse visa

You probably need to apply again as if you go to appeal, only material will be considered which was provided at the time of refusal and since your refusal was lawful your appeal will be turned down by judge and the process might take months. Best way is to apply again and write the reason for refusa...

Re: Marrying an illegal immigrant in the UK

I am not sure if you can marry as you need home office permission to get married and since you're ilegal I think home office might detain you at some point. I'll be very surprised if home office grants you permission. If you get married, she can go back to USA and you go back to India and apply your...

Re: Home Office Dodged Child's Birth Certificate

In 2016 I applied with my British partner under FLR(fp), after living together for 1 year, the application was refused stating that we've not lived together for 2 years, not married and has no child, we went for JR oral hearing and lost the case. We got married after 1 year, by then we've lived tog...

Re: Send document to sheffield

If the documents were issued after the application date, it might cause some trouble. I don't see any problem otherwise as long as they are provided with cover letter and reference number but it might cause confusion and it could go against you. I think there isn't anything you can do, so no need to...

Re: A few questions on Spouse Visa

Can she go back to home country before her visa expired, you get your ILR and apply spouse visa?
Or apply dependent visa then send another form for changes in circumstances, it wouldn't be premium service but you get away paying any extra money none the less.

Re: Spouse Visa Refused - appeal/re-apply

The quickest way is to re apply. Do you meet financial requirement now? And does your husband has english language test still valid and accepted by homeoffice? If no, I would still recommend wait another 6 months for your payslips and english test and re apply with all supporting documents. You can ...

Re: Upper tribunal granted a permission, Advice needed

Your solicitor is right, since the DNA text you don't have grounds on eea basis and it might affect your case. Your daughter is over 7 years and on human rights ground she shouldn't be forced to go out and live in another country. I am not sure if you can win this appeal but I am sure that you have ...

Re: UK spouse visa 2nd job

Category A is fine. The email you received from homeoffice must have explained how you can contact them. Do it as soon as you can. I still doubt if they will reject your application becuase they can not contact the employer, they can contact you to find out what is going on but you never know, it's ...

Re: UK spouse visa 2nd job

Did you apply under category a? They wouldn't just make assumptions on google search and reject. They will call you and then call your employer to confirm the changes and might ask documentation too. Does homeoffice has up to date contact details to contact your employer? If not, you should update t...

Re: Minimum Financial requirement, Help please!

I don't think you will fall under category A if you are not earning the required wages through one major job. However, category B allows to combine more than 1 jobs for which you firstly need to have earned £18600 during the last 12 months/52 weeks and secondly must have earned at least £9300 durin...

Re: Financial Requirement £18,600

SO the correct answer to my question (Is it compulsory to show 6 months payslips ?) is NO. According to the guidance, If someone is employed with salary more than GBP 18,600 AND has already earned gross 18600 BEFORE the date of application (within last 12 months), they need not wait for 6 months or...
