They are applied to all cases which aren't either (a) Article 8* inside the Immigration Rules or (b) fall into other specific immigration provisions. "Public interest" is in economics elf- sufficiency of migrants, people speaking English and integrating into the community, and immigration control. That's what the statute says.

It's possible to argue that in particular circumstances obtaining a passport isn't re-availing yourself.

It's extremely unwise to risk it.

If your application has been refused with no right of appeal you don't carry on accumulating lawful leave. You won't get to 10 years.

There's quite a lot of confusion in your post. Firstly, judicial review doesn't stop any removal action or anything in itself. The Home Office can remove you legally while your have a judicial review waiting, nothing to stop them. So you not knowing that the JR has been refused on the papers doesn't...

I don't see how applying for a new passport would invalidate her application. As long as she is who says she is, and that is the same person is on the passport that is with the Home Office, I don't think it will affect her current pending application at all.
