I don't get the legimiate / illegitimate comparison at all - as in the UK both have equal rights of inheritance if a parent dies intestate.

It is a choice people make for themselves, to throw away the best part of their lives (as you put it). Not something that is imposed upon them.

As a general rule, the marriage needs to be on-going at the end of the 2 year period for you to apply to stay. But it does depend on your individual facts as well, so you shoudl consider taking legal advice.

Hi, As I understand it, there are 2 issues here - firstly deportation as a result of the criminal offence, and secondly the fact that he doesn't have leave in the first place. The second issue makes it easier for the Home Office to deport on the first issue. As he has been here 13 years, there may w...

If II have a legal status, they will stop doing illegal act. Most of the IIs have to use a fake ID to find a job in order to survive, or they might just involve in illegal act themself because no legal business will employed them. It's a catch 22. All we are asking is to give a permit to work here,...

Very best of luck - a lot of us are watching that case, because it will have a big impact whatever the decision is.

Legitimate expectation is a big issue in immigration law these days.

Here we go again. I've pointed out in other threads that "illegal immigrant" is used for hundreds of thousands of people in this country who have done nothing illegal. But it's a good lynch mob call to arms and works to whip up public frenzy. Politicians use the term because the gullible - like you...

"If my evidence can't be entered together with the other documentation, there is always the chance that I can get involved as an "amicus curiae", in which I'm not part of the case but the outcome of it will effect me. " That can't be right - an amicus is a friend of the court, someone who gives expe...

There are two problems with this story: 1) The Home Office will find it very difficult to revoke the British citizenship (whether they obtained it legally or not) of any Kosovan/Albanian who does not also hold Albanian/Serbian or any other citizenship. If they did this it would render the person st...

Hi - I've seen 20-odd letters which accuse people of obtaining leave to remain by pretending they were from Kosovo when they were actually from Albania.

The Home Office is therefore seeking to revoke nationality or ILR, depending on the circumstances of the person.

Hi, I note from your messages that your partner is an Afghan national? There is a recent AIT panel decision which says that if all aspects of the Immigration Rules are met except the need for entry clearance, it is unreasonable to expect a person to return to Afghanistan to apply as there are no Ent...
