Re: General Query, Refusal Impact on Citizenship Application

1. Is there any section or question in the form that requests that information? If yes, then do it, if not then what’s the point. - There is a section that asks about all previous Immigration applications, better to mention as they have all this info anyway. - You haven't mentioned the reasons for ...

Re: BC application with passport and Brp in different name

My other question is will the Home office retain my current passport while considering my BC application? NO. You don't need to submit original documents with the new online applications. You only need to scan and upload. You then bring all original passports for checking when you attend your bio-m...

Re: Can I apply for British citizenship if my child is British

Giving wrong advice when you are not sure yourself can end up costing someone a lot of money. In case I didn't make it clear already: I stand corrected! Why would I post anything if I wasn't sure of it? Either way, this back and forth will be beneficial not just to the OP and me but to anyone else ...

Re: Can I apply for British citizenship if my child is British

Please do not post incorrect advice . For ilr a person needs 5 years residence on a qualifying visa (or 10 years if on a 10 year FLR fp route). There is no route anymore that is 3 years visa for ilr as spouse of British citizen. Fair enough, I stand corrected. However we all post what we believe to...

Re: British Citizenship

It should have all the requirements in general. Read it, and then ask if there is anything specific to his circumstances that you...

Re: British Citizenship

I should add the Life in the UK test does not expire. But as CR001 said he would likely need to take the English Language at B1 CEFR level or better at HO currently approved centres.

No he doesn't. He can send the same ones.
Likely not if the English test is not B1 AND not on the current HO approved list, which a 2011 English likely won't be.
Correct! Also did he use it for the ILR application? It expires after 2 years unless it was used before for settlement.

You are saying conflicting and confusing dates! You did not answer what Casa has asked. It's impossible to help you without a clear picture. Did he come back in 2010 or 2011? When he came back, did he come back on the grounds of being your spouse? If not, what was his Visa status on his return befor...

Re: Question on eligibility for the British Passport

You need EXACTLY 1 year minimum of ILR (NOT even 28 days before, that's only applicable to immigration Visas not Citizenship) before you can apply for British Citizenship regardless of when you were eligible. So in your case March 2020. Unless you're married to a British Citizen then you can apply a...

Re: Questions for Neutralization

1. Am I eligible to apply Citizenship now? Since I'm married to the British Citizen, I understand that I do not need to wait 12 months to apply after getting ILR. Not sure about this as your ILR is based on your Long Residence rather than your spousal visa - Will leave this for experts to answer. I...

Re: 10 years ilr now citizenship help

If you continue to complete the online application you will see that it will ask you to fill in your referees' details i.e. full name, address, occupation and British passport number. You can only do this online as the declaration form will not have this option.

Re: Referee declaration scanned through

Thank you all for your responses. We did not have any issues with the UKVCAS and now we wait for the Home Office! The referee was genuine so guessing the worst that could happen is the HO contacting them to confirm. Will come back to update with any outcome re this topic in a few/many months!

Referee declaration scanned through

Hi All, I have a question. I'm helping a relative with their application. One of their referee is currently abroad on holiday so they signed the form and scanned it over. When appointment time with UKVCAS comes it'll be obvious to them that one of the Referee declarations is a copy, will this be a p...

Your best bet is to apply for BC after 31/12/2020 i.e. 10 years after your status was regularised, provided you meet all other requirements.

Re: Good Character for British Citizenship

This distinction of your application being Invalid and not Refused cannot be underestimated. If they are going to refuse you BC, this will be the reason....

Re: BRITISH Citizenship Application refused due to Breach of Immigration Law

It looks like you had 2 breaches of Immigration control. One was overstaying and the other is working without immigration status that allowed work. They refused your BC not for overstaying but for working without HO permission. On the grounds of overstaying alone (which it sounds like is what you pr...

He had a further 2 council issued PCNs whilst application was with HO. All were under 3 years. Granted, he is a secon...

Re: BC Refused "Breach of immigration law" confused.

Only those who reapply within 28 Days of the rejection are afforded Discretion . I don't believe this is true for citizenship. For ILR, yes. I was only disputing your assertion that Discretion is only given for ILR and not Citizenship, which it is - as long as the set conditions are met. The OP was...
