Re: Good Character for British Citizenship

Hi da09aam, have a read of this document on page 26 https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/665387/naturalisation-as-a-British-citizen-by-discretion-v2.0EXT.pdf • the applicant had made an ‘in-time’application, but the application was rejected ...

Re: BRITISH Citizenship Application refused due to Breach of Immigration Law

It looks like you had 2 breaches of Immigration control. One was overstaying and the other is working without immigration status that allowed work. They refused your BC not for overstaying but for working without HO permission. On the grounds of overstaying alone (which it sounds like is what you pr...

Re: Payment time frame for naturalisation

Hello, I am in slight panic: we submitted documents for naturalisation on 09/08 via Nationality Checking Service, documents reached the office on 10/08 early in the morning, but payment still haven't been taken out of my account.... For the applications we did at NCS on 28 April, the money was take...

Re: Fixed Penalty Notices/ PCN Declaration

I'm no expert on this but if it helps, the person for whom I originally posted this query is now a British Citizen. He had 2 council issued PCNs for parking which we did not declare. He had a further 2 council issued PCNs whilst application was with HO. All were under 3 years. Granted, he is a secon...

Re: BC Refused "Breach of immigration law" confused.

Only those who reapply within 28 Days of the rejection are afforded Discretion . I don't believe this is true for citizenship. For ILR, yes. I was only disputing your assertion that Discretion is only given for ILR and not Citizenship, which it is - as long as the set conditions are met. The OP was...

I would say the clue is in the title of the linked document.

This thread will also help answer your question as to why Discretion wasn't exercised. (I have a vested interest in the Breach of Immigration law which I continue to research hence happy to share what I'm finding) https://www.immigrationboards.com/british-citizenship/citizenship-refused-due-to-breac...

Re: BC Refused "Breach of immigration law" confused.

Having read the few sources in the post, I do not understand why I was not given discretion (or better put as a question, when do they put things in discretion, many people get applications refused, reapply in time, and have no problems with BC) Your resubmission was after 40 days of the first appl...

Re: BC Refused "Breach of immigration law" confused.

I was never rejected (as per my understanding of the term) the FLR was varied, the t1-ext was refused, the appeal was rescinded. Ok, so that option is out. It also would've been negated by the 40 day wait before resubmission as that's beyond the 28 days. Not sure that you're covered by the 3C secti...

Re: BC Refused "Breach of immigration law" confused.

1. Do not compare to the ILR situation, different rules. Correct 2. Likely that some part of the period of extension is considered, though conjecture which actual part (the variation from FLR to PBS or the rescinding of the appeal) 3. It is not typical that they did not cite the exact immigration la...

Re: Good Character effect on dependants

Hi all. I'm aware that the last 4 posts in this thread have been all me! So I'm left to assume that either people really haven't come across this issue before and can't possibly comment or I have muddied the waters a bit as on the face of it my subject title has been answered - and it's No, Good Cha...

Re: BC Refused "Breach of immigration law" confused.

The rest of the BC refusal letter was boilerplate about us not fitting discretion and best to reapply in 2020 when 5 year have passed since immigration law breach.... It would seem that the breach resulted in a failure of the Good Character requirement . However I don't know why they didn't explici...

Re: Good Character effect on dependants

Hi all. Thanks for the above responses. The above mentioned former dependant, minor at time of my visa breach and now adult got his BC approval last week! Yay. I was fairly sure of his application as there is mention of minors not being affected by the transgressions of those they're dependant on. I...

Re: Fixed Penalty Notices/ PCN Declaration

Thank you both very much. So am I right in my understanding from above that he does not need to declare council issued parking tickets which are PCNs? or does he need to declare those as well? He does not have any police issued FPNs. I'd prefer to not have to write a letter about the PCNs if we don'...

Fixed Penalty Notices/ PCN Declaration

Hi all. I've read a few posts about FPNs but cannot find one that's similar to my queries. Hoping someone will know the answers. Hi vinny, never mind I just read the attached case and I get that they tried to make dependants guilty by association. I'll also add that my case is quite different, by miles I'd like to think!

Re: Good Character effect on dependants

They will not be guilty by association. That is to say that they will not punished for you not meeting the Good Character requirements. Not for want of trying ! Hi vinny, I'm a little confused by your comment. Care to elaborate? Anyway whilst we are here, do I take it you confirm secret.simon's ans...

Thank you very much secret.simon for your response. I was mainly worried about the adult dependant. All their applications and appeals were done on time so there was no overstaying incidents.

Good Character effect on dependants

Hi all. I was wondering if anyone knows if failure to meet the Good character requirement extends to dependants. I was in breach of the immigration rules by not informing the HO of a change to my circumstances for a substantial time: 2-3yrs (due to a genuine misunderstanding of the rules). At the ti...

Re: Can Jury duty mitigate Good Character clause

Thank you secret.simon. Your last point referencing a commonwealth student answers my question. I thought it was worth exploring! As it is I will wait until 2020, hoping that the goal post doesn't shift again as it is wont to do from my experience.

Re: Can Jury duty mitigate Good Character clause

Thank you both for your responses. I think there are some other grounds specified to ask for discretion other than the ones you listed, There is one for overstaying due to things like hospitalisation; the length of time - less than 28 days and whether the breach was inadvertent; I think also being a...

Can Jury duty mitigate Good Character clause

Hi all, I have looked around and have not seen any topic regarding anything to do with jury duty and was wondering if there is anyone who might have an idea to my query. My history is that I had a 4 year work permit to a 1yr employment/education contract. Towards the end of the one year I became ill...
