Re: British Moving to Ireland with Non-EU family member

1. No she doesn’t need a visa when travelling with you to Ireland 2. You’ll need to apply for the transfer of residence permit (known as EUFAM in Ireland) when she gets in Ireland. Bear in mind in doing so you are resetting the clock and your spouse will start the 5 years of residence permit from s...

Re: Foreign Birth Registration

Is it a thought that they do try to keep the number of participants at a certain number in order not to have too large of groups when the ceremony happens? Still glad to be here with you all to keep thoughts and progress updated as best as we are all able. There is no ceremony involved in the FBR p...

Re: Proof of recokonable time other than Stamps

But the Supreme court dismissed the state's appeal against that decision in 2012. Therefore that judgement was endorsed. http://courts.ie/Judgments.nsf/0/82A0C6BA4AB8028580257ADB005285FA I don't quite agree that it has no bearing. If you are correct, which I am confident you are not, then what will...

Re: Proof of recokonable time other than Stamps

Did you actually read the case, and what it established. The Supreme court is the highest court in Ireland, and only them are the final abiter of the law. Their interpretation is the law of the land. Did you actually read the case? It is a judicial review delivered by the High Court , not the Supre...

Re: Proof of recokonable time other than Stamps

I'm afraid you are confusing the judicial review by high court with the judgement by supreme court. You provided an example of judicial review . In Ireland, a judicial review is done on a case-by-case basis, and is carried out by High Court , not the Supreme Court. They do not change any legislation...

Re: Non-EU vs EU Queue at the Airport

I have an official response from Dublin Airport: You can use the EU queueif and only if you are exercising your EU Treaty Rights. If you hold a Stamp 4EUFAM, you have the right to exercisie EU Treaty Rights. Therefore you can use the EU queue. If you are the spouse of an Irish national, you hold a n...

Re: Proof of recokonable time other than Stamps

I am not sure that is correct. For argument sake I am prepared to accept that your first point is correct. However the second one is not, as lawful residence for the purpose of the act commence from when the minister issues permission and not when a stamp is endorsed by an immigration officers. Thi...

Re: Proof of recokonable time other than Stamps

If it is a permission given by the minister for you to stay in the state, then it will suffice, provided it is a letter by the minister authorising your stay in the state. The OP was referring to the work permit issued by DBEI. It's not a permission given by the minister. The work permit allows a p...

Re: Proof of recokonable time other than Stamps

No. Stamp is the your only proof.

You were still considered a student if you were working under the Stamp 2. Work permit letters don't mean anything. They are just a permit that allows you to work within a certain date range.

option C would apply for myself and my wife. However we were told that insurance wasn't necessary as long as we don't rely on social welfare. We just got recently insurance. Do you think gap in insurance coverage would be an issue, even if we never relied on social welfare? That’s wrong. You must h...

Re: Citizenship applications from 2017 pending approval

You can go through the immigration control without GNIB card - that’s not a problem. I’ve done it five times. My concern is that with the abolishment of re-entry visas, some airlines may not admit a person on a plane if they don’t have a GNIB card or re-entry visa. In my case I was travelling by Aer...

Re: Critical Skills Employment Permit

I’m more confused now. Did you get a working holiday authorisation initially? If yes, then when this period is over you are legally not allowed to work. Simple as that. The rules on work permit clearly indicated that it takes a few months to process the permit, and you cannot work until you get the ...

I want to bring her to Northern Ireland. See this for current processing dates. https://dbei.gov.ie/en/What-We-Do/Workplace-and-Skills/Employment-Permits/Current-Application-Processing-Dates/Current-Processing-Dates-for-Employment-Permits.html You cannot work if your Stamp is expired. Re: Spouse visa?

If you live in Belfast, you apply to the UK Government. The question is whether your spouse can apply under UK domestic law or under EU Treaty Rights. Apparently EU Treaty Rights are much easier and give your spouse more freedom in terms of visa-free travel to other EU countries. As you are a dual n...

Re: Renewal GNIB EU Fam stamp 4

So what is your question? If you didn’t have health insurance, you didn’t have it. Try to explain that in your application and make it clear that you now have it. You can stress that no matter how difficult your situation was back then, you did not rely on state funds (I hope you didn’t) and you wor...

Re: Ibc visa

The length of your Stamp 4 depends on the role you play in your child’s life and also your immigration history. Per INIS website, the length of permission can be anywhere between 6 months and 3 years. If you hold a proper Type D join family visa before you come to Ireland, you will likely get a long...

As long as you can prove that you are *joining* her, you will be fine. Bring the hotel bookings, flight tickets and marriage cert of course. Most border controls don't even question you as long as you say anything about EU treaty rights. Some airlines like Ryanair will check for visas. They may ask ...

I got my approval in April, while he only got the second stage letter yesterday. He has a very similar application as yours I believe. His work r...
